AN ORDINANCE DIRECTING THE CITY ATTORNEY TO BRING CONDEMNATION
PROCEEDINGS AGAINST CERTAIN PARCELS Or REAL PROPERTY FRONTING
ON CANTRELL ROAD IN THE CITY OF LITTLE ROCK TO BE USED FOR THE
PURPOSE OF CONSTRUCTION EASEMENTS ONLY IN THE WIDENING AND PAVING
OF SAID CANTRELL ROAD; AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK,
ARKANSAS:
cECTION 1. The City Attorney is hereby ordered and directed to
file in the proper courts proceedings for the condemnation of con-
struction easements in and on the following described parcels of real
property situated in the City of Little Rock, Arkansas, to -wit:
The South 10 feet of the following parcel of land: Part EZ
NWT NE4 NW- Section 36, Township 2 North, Range 13 West de-
scrived as-.beginning at Southwest corner of 5 acre tract which.
is EZ NW'k NEk NW4, Section 36; thence North along West line said
5 acre tract 126.6 feet; thence East 20 feet to a point on North
right of way line of Hwy. 10 and which is point of beginning;
thence North parallel West line said 5 acre tract 96 feet; thence
South 762 degrees East 49.95 feet; thence South 106.6 feet to
North right of way line of said Highway; thence Northwesterly
along said right of way line 53.2 feet to beginning. Said property
is owned by Carl D. Smith and Faustine Smith, his wife.
All that part NWk NE-k Section 4, Township 1 North, Range 12 West
which lies South of Highway 10 and North of Lot 1, Block 4 and
North Lots 5 and 6. Block 4, Virginia Heights Addition to the
City of Little Rock. Said property is owned by Manie Schuman.
The properties hereinabove described are necessary and are to be utilized
for construction easements only for the purpose of widening Cantrell Road
in the City of Little Rock, Arkansas.
SECTION 2. The City Attorney is further directed to secure an Order
of the Court allowing the City to take immediate possession of the pro-
perties described hereinabove upon its posting a bond in an amount to
be determined by the Court. 'The City Attorney is authorized to have
posted on behalf of the City a bond in the amount determined by the Court
pending final determination of the condemnation proceedings.
SECTION 3. All ordinances and parts of ordinances in conflict here-
with are hereby repealed.
SECTION 4. It has been found and determined that the safety of the

citizens of the City of Little Rock is jeopardized by reason of the
narrow width of Cantrell Road and that the condemnation of these
parcels of real property will enable the widening of said Cantrell
Road so as to reduce said traffic hazard; now therefore, an emergency
is hereby declared to exist, and this ordinance being necessary for
the preservation of public peace, health and safety shall be in full
force and effect from and after its passage and approval.
