HomeMy WebLinkAbout11107ORDINANCE N0. 1107 AN ORDINANCE DECLARING THE OPERATION OF A NURSING, CONVALSECENT OR OLD AGE HOME TO BE A PRIVILEGE, DEFINING A NURSING, CONVALESCENT OR OLD AGE HOME; PROVIDING FOR THE ISSUANCE OF A LICENSE TO OPERATE A NURSING, CONVALESCENT OR OLD AGE HOME AND ESTABLISHING A FEE THEREFOR; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE. ROCK, ARKANI SAL SECTION 1. It is hereby found and declared to be a privilege for any person, firm or corporation to operate a nursing home, convalescent home and old age home within the City of Little Rock. SECTION 2. A Nursing Home, Convalescent Home or Old Age Home means a building used for thelodging, boarding or nursing care on a 24 -hour basis o� four or more infants, convalescents or aged persons, but shall not include hospitals and mental or correctional institutions. This shall not include members of the immediate family of the operator or owner. *..SECTION 3. No person, firm or corporation shall operate in the City of Little Rock, Arkansas, a Nursing Home, Convalescent Home or Old Home without first securing from the City Collector a license. Appli- cation for such license shall be made on a form to be provided by t_e City Collector. The City Collector shall issue such license after the said City Collector has notified the Fire Department, Health De- partment and City Engineer of the City of Little Rock, Arkansas, and after he has received from each of the departments so notified, a state- ment that the premises to be occupied by such Nursing Home, Convalescent Home or Old Age Home are kept and maintained according to the applicable laws, ordinances and rebulations of the City of Little Rock. SECTION 4. Any person, firm, or corporation desiring to obtain the license herein provided for shall pay to the City Collector before such license is issued to such person, firm, or corporation, annual fees at the _ate of 75� per patient or occupant bed contained in said Nursing Oo0 -/7 b - '� l \ -2- Home, Convalescent Home or Old Age Home, for the purpose of defraying the cost of periodic inspection by the Departments of the City of Little Rock, Arkansas. SECTION 5. Any person, firm or corporation who shall operate, nave or conduct any Convalescent Home, Nursing Home or Old Age Home without having first secured a permit or license as hereinabove pro- vided or wino shall violate any other provisions of this ordinance shall be declared builty of a misdemeanor and upon conviction shall be fined any sum not less than $25.00 and not more than $250.00, or imprisonment for not less than two days or more than 30 days, or both fine and imprisonment in the discretion of the Court, and each day's operation without a license or in violation of any other provisions of this ordinance shall constitute a separate offense. SECTION 6. Ordinance No. 9323 in its entirety and all other orli- nances and parts of ordinances in conflict herewith are hereby repealed. SECTION 7. Whereas, Nursing Homes, Convalescent domes or Old Age domes are established where aged, helpless and infirm people are con- centrated; and Whereas, the possibility of loss of life due to fire or throu -i disease is greater among the aged, sick and infirm; and WHEREAS, the City of Little Rock has heretofore had in- adequate control over Nursing Homes, Convalescent Homes or Old Age Homes; ., and Whereas, all this creates a grave dander to the public peace, health and safety, an emergency is hereby declared to exist and this ordinance shall be in full force and effect from and after its passage and approval.
