HomeMy WebLinkAbout11151ORDINANCE NO. 11,151 AN ORDINANCE AMENDING ARTICLE 3 OF SECTION 1 OF ORDINANCE NO. 9766, SAME BEING: "AN ORDINANCE PROVIDING FOR AN AGREEMENT BETWEEN THE CITY OF LITTLE ROCK, PULASKI COUNTY, THE CITY OF NORTH LITTLE ROCK AND THE CITY OF JACKSONVILLE, ARKANSAS, FOR JOINT COOPERATION IN AREA PLANNING AND THE ESTABLISHMENT OF A METROPOLITAN AREA PLANNING COMMISSION UNDER THE PROVISIONS OF ACT NO. 26 OF THE 1955 ASSEMBLY OF THE STATE OF ARKANSAS, AND FOR OTHER PURPOSES. "; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. Article 3 of Section 1 of Ordinance No. 9766, same being: "An Ordinance providing for an Agreement between the City of Little Rock, Pulaski County, the City of North Little Rock and the City of Jacksonville, Arkansas, for joint cooperation in area planning and the establishment of a Metropolitan Area Plan- ning Commission under the Provisions of Act No. 26 of the 1955 Assembly of the State of Arkansas, and for other purposes. ", is hereby amended to read as follows: "Article 3. Membership of the Commission. The Metropolitan Area Planning Commission shall be constituted as follows: Ex- Officio elected officials. The County Judge, the Mayor of North Little Rock, the Mayor of Jacksonville, one member of the City Council of North Little Rock,and two (2) employees of the City of Little Rock as designated by the Board of Directors from time to time shall be ex- officio members and shall be entitled to vote on all matters. Ex- Officio appointed officials. The Chairmen of any existing planning commission or board of the parties of the agreement ppp -a..o -2- shall likewise be ex- officio members and shall be entitled to vote on all matters. Appointed members. The County Judge shall appoint three members who hold no other public or appointive county or municipal office other than appointive membership in a planning commission or board. These members shall be appointed for a term of 3 years, except that the respective terms of the members first appointed shall be 1, 2, and 3 years. The City Manager of the City of Little Rock with the approval of the Board of Directors of the City of Little Rock shall appoint 3 members who hold no other public or appointive county or munici- pal office other than membership on a planning commission. These members shall be appointed for a term of 3 years, except that the respective terms of the members first appointed shall be 1, 2 and 3 years. The Mayor of the City of North Little Rock shall appoint two members who hold no other municipal office other than appointive membership on a planning commission. These members shall be ap- pointed for a term of 3 years except that the respective terms of the members first appointed shall be 1 and 2 years. The Mayor of Jacksonville shall appoint one member who holds no other municipal office other than appointive membership on a planning commission. This member shall be appointed for a term of 3 years. Terms of Members. The terms of ex- officio members shall be for the period in which they occupy their county or municipal offices, provided that in the event any planning commission or board no longer functions, the ex- officio membership of the chairman of such commission or board shall be replaced by an appointive -3- membership. All members of the Commission shall serve as such without compensation. A member of the Commission, once qualified, shall not be removed during his term of office except for cause and after a hearing held before the governing body by which he was appointed. Vacancies occurring otherwise than through the expiration of terms shall be filled for the unexpired term by the offi- cial appointing the original holder of said membership. Increase of membership. The membership of this Commission may be increased automatically when any other political subdivision or other public body, as provided by Act 26 of the 1955 Assembly of the State of Arkansas joins in this agreement. Each such additional political jurisdiction or public body shall appoint one member to the Commission. When such new member- ship is added the Commission shall establish such additional appointive membership as may be required to maintain the majority of appointive memberships to conform to the requirements of Section 3 of Act 26 and shall request the parties to the agreement to make such additional appointments as may be required." SECTION 2. All ordinances and parts of ordinances in conflict herewith are hereby repealed and this ordinance shall be in full force and effect from and after its passage and approval.
