HomeMy WebLinkAbout11152ORDINANCE NO. 11,152 AN ORDINANCE VACATING AND ABANDONING AN ALLEY IN BLOCK 116, ORIGINAL CITY OF LITTLE ROCK AND FOR OTHER PURPOSES. WHEREAS, a petition was duly filed with the Board of Directors of the City of Little Rock, Arkansas, on the 12th day of December, 1960, asking the Board of Directors to vacate, discontinue and abandon the alley described in said petition and hereinafter described; WHEREAS, after due notice as required by law, the Board of Directors has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained: that the alley sought to be vacated and hereinafter described lies wholly within the corporate limits of the City of Little Rock, Arkansas; that the original plat of Block 116, Original City of Little Rock made by Roswell Beebe on February 29, 1840, does not show any alley in said Block 116; that the 20 foot strip which has heretofore (many years ago) been shown as an alley is actually the West 10 feet of the East half and the East 10 feet of the West half of said Block 116; that no part of said 20 foot strip sought to be vacated as an alley has been used as an alley at any time during the past twenty-five (25) years; that no part thereof is required or needed for corporate purposes or as an alley or passageway by the public generally or by anyone; that the owners of all the property abutting upon said twenty foot strip (referred to as an alley) to be vacated, discontinued and abandoned have filed with the Board of Directors their written consent to such abandonment; and, that public interest or welfare will not be adversely affected by the abandonment of said twenty foot strip as an alley; provided, the existing easement for telephone installations and for electric power installations shall not be changed or disturbed by this Ordinance as provided hereinafter. NOW, THEREFORE, be it ordained by the Board of Directors of the City of Little Rock, Arkansas: ODO-a0 .D -3 -2 - Section I. The City of Little Rock, Arkansas, hereby releases, vacates, discontinues and abandons all of its rights, together with the rights of the public generally in and to the alley designated as follows: A strip of land twenty (20) feet in width running North and Sow- through-the center of Block One Hundred Sixteen (116), Original City of Little Rock, Pulaski County, Arkansas, extending the entire length of said Block from the South line of Capitol Avenue Southerly to the North line of West 6th Street in the City of Little Rock, Arkansas. Provided, that the existing easement for telephone installations and for electric power installations in said 20 foot strip including the right to repair, replace, add to, extend and enlarge the same as future demands may require shall not be changed or disturbed by this Ordinance. Section 2. The absolute ownership of the West ten feet of said twenty foot strip hereinbefore described shall vest, be and remain in the owners of Lots 1, 2, 3, 4, 5 and 6 in said Block 116 and the absolute ownership of the East ten feet of said twenty foot strip hereinbefore described shall vest, be and remain in the owners of Lots 7, 8, 9, 10, 11 and 12 in said Block 116, Original City of Little Rock, Arkansas, and such ownership shall be free from the easement of the City for public use as an alley or passageway. Section 3. A copy of this ordinance duly certified by the City Clerk shall be filed in the Office of the Recorder of Pulaski County, Arkansas, and recorded in the deed records of said County. Section 4. This ordinance shall take effect and be in force from and after its passage. PASSED: February 20, 1961 ATTEST: CITY CLERK �t 1
