HomeMy WebLinkAbout11153A _ � ORDINANCE No. UP 1.53 AN ORDINANCE VACATING, ABAMCNING AMID CLOSING PCRTIONS OF CERTAIN ALLEYS LOCATED IN WESTROCK ADDITION TO TFE CITY OF LITTLE ROCK, ARKANSAS, IN CONFORMANCE WITH THE PROVISIONS OF THE URBAN RENEWAL PLAN FOR THE WESTROCK AREA PROJECT, PROJECT ARK R -4, AND FOR OTFER PURPOSES. WHEREAS, under the provisions of Ordinance No. 10,870, duly adopted by the Board of Directors of the City of Little Rock, Arkansas, on November 17, 1958, the Urban Renewal Plan of the Housing Authority of the City of Little Rock, Arkansas, for the Westrock Area Project, Project ARK R -4, was formally approved; and WBEREAS, said Board of Directors in said Ordinance found that in order to implement and facilitate the effectuation of said Urban Renewal Plan, certain official action must be taken by the Board of Directors, including the vacation and removal of streets, alleys and other public Kays, the establish- ment of new street patterns, changes in zoning, and the location and relocation of sewer and water mains and other public facilities, all as provided for in said Plan; and WBEREAS, the objectives of said Plan have now been sufficiently attained to require that official action be taken to vacate, close and abandon the hereinafter described portions of certain alleys in Westrock Addition to the City of Little Rock, Pulaski County, Arkansas, in .addition to those portions of certain streets and alleys in said Westrock Project closed by Ordinance No. 11041 enacted March 21, 1960; and WHEREAS, said portions of said alleys are no longer needed for use for travel by motor vehicle, pedestrian or other traffic and for means of access to other lands, and are accordingly no longer needed for corporate purposes; and WHEREAS, under said Urban Renewal Plan provision is made for other suitable, safe, adequate and convenient means of access to and egress from the area involved; and WHEREAS, in order to better provide for the public welfare, safety, comfort and convenience of the general public, the inhabitants of the City of Little Rock, Arkansas, and the users of said alleys, it is necessary to vacate, close and abandon those portions of alleys hereinafter specifically described: R Oo0 -z0 .D -s - 2 - NOW, THEREFORE, EE IT ORDAINED BY TflE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. That it is hereby ascertained and declared that the use, as public alleys, of those portions of the hereinafter described alleys located in Idestrock Addition to the City of Little Rock, Pulaski County, Arkansas, is no longer necessary and needed by adjoining landowners, the general public and for access to other lands in the vicinity; that other streets and routes are presently in existence which reasonable, safely and adequately serve the needs of those members of the public, traveling to and from areas now or previously served by said portions of the above mentioned alleys; that said portions of said alleys are no longer required for corporate purposes as public alleys and should accordingly be vacated, abandoned, and closed, and all of the right, title and interest of the City of Little Rock, Arkansas, except as hereinafter set forth in Section 3, in the said vacated portions of said alleys should revert to the adjoining landowners. Section 2. That the City of Little Rock, Arkansas, under its powers as set forth in Arkansas Statutes (19117) Section 19- 2304, and Section 19 -3029, hereby vacates, abandons and closes the following described alleys, and relinquishes, grants and conveys onto the adjoining landowners all of the right, title and interest of the City of Little Rock, Arkansas, of its inhabitants, and the public generally, except as hereinafter set forth in Section 3, in said alleys, to -wit: All of the alleys running generally north and south in Blocks 1, 2, 6 and 7, Westrock Addition to the City of Little Rock, Arkansas. Section 3. There is expressly reserved unto the City of Little Rock, Arkansas, and all duly authorized public utilities, their successors and assigns, easements upon, over and across the full width of said alleys being vacated, abandoned and closed, for the purpose of installing and maintaining utility lines, said easements to be shown upon and established by a replat to be filed by the owners of the adjoining lands in the area. Section 4. That a copy of this Ordinance, duly certified by theCity Clerk, shall be filed in the office of the Recorder of Pulaski County, Arkansas, and recorded in the Deed Records of said County. - 3 - Section 5.
