ORDINANCE NO. 119189
AN ORDINANCE AMENDING PARAGRAPH A, SECTION 10 OF ORDINANCE
NO. 10,843, SAME BEING AN ORDINANCE ESTABLISHING STANDARDS
AND SPECIFICATIONS FOR THE CONSTRUCTION AND RECONSTRUCTION
OF SIDEWALKS, DRIVEWAYS, CURBS AND GUTTERS ON PUBLIC PRO-
PERTY; AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE
ROCK, ARKANSAS:
SECTION 1. Paragraph A, Section 10 of Ordinance No. 10,843,
which establishes standards and specifications for the construction
and reconstruction of sidewalks, driveways, curbs and gutters on
public property, is hereby amended to read as follows:
"Paragraph A. The provisions of this Ordinance shall
not apply to the construction of any public works by or
at the instance of the City of Little Rock on any public
property. But it shall be the policy of the City of Little
Rock to construct all public works consistent with the
provisions of this Ordinance except in those cases where
the Board of Directors should find it necessary in the
public interest to vary therefrom.
Furthermore, the provisions of this
ordinance may be waived by resolution of the Board of
Directors as same apply to construction proposed or under-
taken on public property by any governmental body or agency
including, but not limited to, the United States of America,
State of Arkansas, County of Pulaski, or any other duly
constituted political subdivision of the said State or County,
provided said waiver shall be found necessary by the Board
of Directors to provide said governmental unit with the
maximum beneficial use of its property and that said waiver
does not create a hazard to the public health, safety or wel-
fare."

SECTION 2. All ordinances and parts of ordinances in
conflict herewith are hereby repealed and this ordinance shall
be in full force and effect from and after its passage and
approval.
