ORDINANCE NO. 11,207
AN ORDINANCE REQUIRING CERTAIN PHYSICAL EXAMINATIONS
OF HANDLERS OF FOOD AND DRINK PREPARED FOR HUMAN CON-
SUMPTION AND HANDLERS OF UNPACKAGED PRODUCE; PROVIDING
A PENALTY FOR VIOLATION THEREOF; DECLARING AN EMERGENCY;
AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK,
ARKANSAS:

� SECTION 1. Hereafter, no person employed for wages as a

handler of food, drink or unpackaged produce prepared for human
consumption or food, drink or produce, or constituents thereof, in
unpackaged form, or as a domestic servant of any kind or class shall
obtain or continue in such employment without first obtaining from
the City Health Department a health certificate.
SECTION 2. Wages is defined, "to be money or anything
of value."
SECTION 3. Handler of food and drink prepared for human
consumption and of unpackaged produce is defined as, "any person
who in any way comes in contact with food and drink and unpackaged
produce in a form in which such food, drink, or unpackaged produce
is not contained in a container where human hands cannot touch it.
It includes also any person who may handle such produce for display
or in the process of selling it."
SECTION 4. Said health certificate shall be in such form
as may be prescribed by the Public Health Director and shall be
effective only for the period of time indicated on the certificate
itself, and it shall be issued by the Public Health Director only
when the applicant therefor has passed, to the satisfaction of the
Public Health Director, an exarination for Venereal and other com-
municable diseases, including Tuberculosis.
SECTION 5. The examination for Tuberculosis shall be made
by X -Ray of the chest by any competent Roentogenologist, provided
however, that the Public Health Director is empowered in his dis-
cretion to require an X -Ray examination by a Roentogenologist of
the Public Health Director's own choosing. The examination for

Venereal and other communicable diseases shall be by tests as the
Public Health Director may from time to time prescribe.
SECTION 6. The examination for Tuberculosis and the exami-
nation for Venereal and other communicable diseases shall be con-
ducted at least as often as every twelve (12) months. Each appli-
cant for examination shall pay a fee of Two Dollars ($2.00) to the
Public Health Director.
SECTION 7. The Public Health Director shall have the
authority to suspend from work anyone who has Venereal disease or
communicable disease and may compel any such person who is engaged
as a domestic servant or who is engaged in handling food for public
consumption to take treatment for such diseases.
SECTION S. It is hereby declared to be a misdemeanor for
any person to violate Section 1 of this Ordinance and any person
found guilty of violating Section 1 shall be fined not less than
Five Dollars ($5.00) nor more than Five Hundred Dollars ($500.00),
or imprisoned for not less than one day and not more than thirty (30)
days, or both fined and imprisoned. Each day that the violation is
continued shall constitute a separate offense.
SECTION 9. The employers of handlers of food or drink pre-
pared for human consumption, and of unpackaged produce, are required
to keep possession of the handler's certificate while the person or
persons to whom same is issued remains in their employment, and it is
hereby declared to be a misdemeanor for any person, firm or corporation
employing a handler of food or drink prepared for human consumption,
or unpackaged produce, to fail to have such person's health certificate
in their possession at all times for exhibit, on demand, to the
Public Health Director. Any person found guilty of such misdemeanor
shall on conviction be fined in a sum of not less than Five Dollars
($5.00) nor more than One Hundred Dollars ($100.00) or imprisoned
for not less than one day and not more than thirty (30) days, or
both fined and imprisoned.

SECTION 10. That all ordinances and parts of ordinances
in conflict herewith are hereby repealed; that because Venereal and
other communicable diseases may be transmitted through the medium
of food and because at the present time there is no adequate method
of examining persons handling food or drink prepared for human
consumption, or of unpackaged produce, and because the public health
of Little Rock is greatly endangered thereby, and because this and
the requirements of this ordinance are helpful in correcting this
pressing and immediate problem, an emergency is hereby declared to
exist, and this ordinance shall be in�full force and effect from
and after its passage.
