AN ORDINANCE APPROPRIATING TWENTY EIGHT THOUSAND TWENTY SIX
AND 03/100 DOLLARS ($28,026.03) TO COMPLETE THE CONTRACT
PRICES AND INCIDENTAL EXPENSES FOR CONSTRUCTION OF UNIVERSITY
AVENUE; AND FOR OTHER PURPOSES.
WHEREAS, Ordinance No. 11,139, same being the Budget Ordinance
of the City of Little Rock, Arkansas, for the year 1961, reflects
that a reserve has been established encumbering a sum of Four Hundred
Fifty Thousand and No /100 Dollars ($450,000.00) for use on the Eighth
Street Improvement Program; and
WHEREAS, by Ordinance No. 11,166 the sums of Thirteen Thousand
Five Hundred and No /100 Dollars ($13,500.00) and Thirty -Three Thousand
Seven Hundred Eighty and 18/100 Dollars ($33,780.18) were appropriated
reducing said reserve to Four Hundred Two Thousand Seven Hundred
Nineteen and 82/100 Dollars ($402,719.82); and
WHEREAS, the costs and expenses in connection with the proper
completion of University Avenue require additional moneys to complete
the contract prices and incidental expenses; and
WHEREAS, it is the desire of the Board of Directors of the
City of Little Rock to use a portion of the funds encumbered for use
in the Eighth Street Improvement Program for the purpose of meeting
needs and obligations of the University Avenue Project;
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. The sum of Twenty Eight Thousand Twenty Six and
03/100 Dollars ($28,026.03) is Hereby appropriated from surplus in
the General Fund, previously encumbered and allocated by Resolution
No. 2546 for use on Eighth Street Right -Of -Way Project, to Street
Construction Fund, Project 3, for use in completing the contract
prices and extra work on University Avenue ordered or authorized by
the City of Little Rock.

SECTION 2. Whereas, construction of University Avenue
in the City of Little Rock is complete; and Whereas, there are
certain sums due a contractor under the contract sum and for
extra work ordered by the City of Little Rock; and Whereas this
appropriation is necessary in order to enable the City to meet
its obligations and to maintain its credit and reputation in
honoring obligations; and Whereas, immediate payment of the sums
necessary to pay in full all the obligations of the City arising
out of the construction of University Avenue is in the best
interests of the public welfare and safety; now therefore, an
emergency is hereby declared to exist and this ordinance shall
be in full force and effect from and after its passage and approval.
