ORDINANCE NO. 11,259
AN ORDINANCE VACATING, ABANDONING AND CLOSING
A PORTION OF ALLEY TRAVERSING BLOCK 60,
PULASKI HEIGHTS ADDITION TO THE CITY OF LITTLE
ROCK, ARKANSAS.
WHEREAS, a petition was duly filed by Walter E.
Daniels and Ruth Daniels, Aloysius John, Jr., and Grace Wrape,
and A. W. Johnson and Ruth Y. Johnson, with the Board of
Directors of the City of Little Rock, Arkansas, asking the
Board of Directors to vacate, abandon and close that portion
of an alley adjacent to and abutting the West boundary line
of the East one -half of Lots 7, 8 and 9, Block 60, and adjacent
to and abutting the East boundary line of Lots 4 through 6,
Block 60, Pulaski Heights Addition, all in the City of Little
Rock, Arkansas, as more particularly described hereinafter;
and
WHEREAS, after due notice as required by law, the
Board of Directors has, at the time and place mentioned in the
Notice, heard all persons desiring to be heard on the question
and has ascertained that the portion of the alley,hereinafter
described, has heretofore been dedicated to the public use
as a street, has not been actually used by the public generally
as a street, road, or alley for a period of at least five (5)
years subsequent to the filing of the plats of said addition
referred to above, that petitioners are the only abutting land-
owners upon the portion of the alley to be vacated, and
accordingly all abutting landowners have consented to such
abandonment, and that the public interest and welfare will not
be adversely affected by the abandonment of such alley.

NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS:
Section 1. The City of Little Rock, Arkansas, hereby
releases, vacates and abandons all its rights, together with
the rights of the public generally, but specifically excepting
any utility easements now in effect, including those specifically
mentioned in Section 2 hereof, in and to the alley described as
follows:
That portion of said alley adjacent to and abutting
the West boundary line of the East one -half Q) of
Lots 7, 8 and 9, Block 60, and adjacent to and abut-
ting the East boundary line of Lots 4 through 6,
Block 60, Pulaski Heights Addition, all in the City
of Little Rock, Arkansas, and more particularly
described as follows:
Begin at a point at the Northeast corner of Lot 9;
thence South to the Southeast corner of Lot 7; thence
Eastwardly to the Southwest corner of Lot 6; thence
North to the Northwest corner of Lot 4; thence West-
wardly to the Northeast corner of Lot 9, the point
of beginning, all in Block 60, Pulaski Heights
Addition to the City of Little Rock, Arkansas;
and that the ownership thereof, except as to said utility ease-
ments, shall vest in the owners of the abutting property, the
owners of the East one -half of Lots 7, 8 and 9, Block 60,
Pulaski Heights Addition to the City of Little Rock, to take
title to the West half thereof, and the owners of Lots 4
through 6, inclusive, Block 60, Pulaski Heights Addition to
the City of Little Rock, to take title to the East half
thereof.
Section 2. This alley closing is subject to the
same rights prior to and at the time of this closing which

Arkansas Power & Light Company, Arkansas Louisiana Gas Company
and Southwestern Bell Telephone Company have under their fran-
chises granted by the City of Little Rock, Arkansas.
Section 3. A copy of this Ordinance, duly certified
by the City Clerk, shall be filed in the Office of the Recorder
of Pulaski County, Arkansas, and recorded in the deed records
of said County.
Section 4. This Ordinance shall take effect and be
in force from and after its passage.
Section 5. All ordinances or parts of ordinances
in conflict herewith are hereby repealed.
