HomeMy WebLinkAbout11260ORDINANCE NO. 11,260 AN ORDINANCE VACATING, ABANDONING AND CLOSING A PORTION OF THE ALLEY LOCATED IN BLOCK 12, WOODRUFF'S ADDITION TO THE CITY OF LITTLE ROCK, ARKANSAS. WHEREAS, a petition was duly filed by The First National Bank in Little Rock, Little Rock, Arkansas, Petitioner, with the Board of Directors of the City of Little Rock, Arkansas, asking the Board of Directors to vacate, abandon and close that portion of a 20 foot dedicated alley located in Block 12, Woodruff's Addition to the City of Little Rock, Arkansas, lying East of the easterly right -of -way line of the Little Rock - North Little Rock Express- way, as more particularly described in said Petition and hereafter; and WHEREAS, after due notice as required by law, the Board of Directors has, at the time and place mentioned in the Notice, heard all persons desiring to be heard on the question and has ascertained that said portion of said alley hereinafter described has heretofore been dedicated to the public use as an alley, has not been in use for several years since the commencement of construction of the Little Rock - North Little Rock, Expressway, that same is no longer needed or required for corporate purposes in that the use by the general public and by adjoining owners is not necessary due to the construction of said Expressway, that Petitioner is the only abutting landowner upon the portion of the alley to be vacated accordingly all abutting landowners have consent- ed to such abandonment, and that the public interest and welfare will not be adversely affected by the abondonment of such alley. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. The City of Little Rock, Arkansas, hereby releases, vacates and abandons all its rights, together with the rights of ccC -A G _,fl r - 2 - the public generally, but specifically excepting any utility easements now in effect, in and to the alley described as follows: That part of a 20' dedicated alley, Block 12, Woodruff's Addition to the City of Little Rock, Pulaski County, Arkansas, lying east of the easterly ROW line of the Little Rock - North Little Rock Expressway, more particularly described as follows: Commencing at the South east corner of said Block 12, Woodruff's Addition, said corner being the intersection of the Northerly ROW line of East 9th Street and the Westerly ROW line of Collins Street; thence North 010 - 301E, 140.01 along the Westerly line of said Block 12 to the Point of Beginning, said point also being the North Easterly corner of Lot 12, Block 12, Woodruff's Addition; thence North 880- 33'West, 75.6' along the northerly line of Lots 12 and 11 to a point; said-point being the intersection of the northerly line of Lot 11 and the easterly ROW line of said Little Rock - North Little Rock Expressway; thence North 120 -34' West along said Expressway Easterly ROW line to its intersection with the southerly line of Lot 2, Block 12; thence South 880 -331, 80.74' along the southerly line of lots 2 and 1 to the South East corner of Lot 1, said corner being on the Easterly line of Block 12, Woodruff's Addition and the Westerly ROW line of Collins Street, thence South 010 -30' West, 20.0' along said Easterly line of Block 12 to the point of beginning; and that the ownership thereof except as to said utility easements shall vest in the owner of the abutting property. Section 2. A copy of this Ordinance, duly certified by the City Clerk, shall be filed in the Office of the Recorder of Pulaski County, Arkansas, and recorded in the deed records of said County. Section 3. This Ordinance shall take effect and be in force from and after its passage. Section 4. All ordinances or parts of ordinances in conflict herewith are hereby repealed.
