HomeMy WebLinkAbout11283ORDINANCE NO. 11,283 ORDINANCE OF THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS, VACATING AND CLOSING A PORTION OF 29th STREET AND THE ALLEY IN BLOCK 5 OF HAMILTON & BRACKIS ADDITION TO THE CITY OF LITTLE ROCK, ARKANSAS. WHEREAS, a petition was duly filed with the Board of Directors of the City of Little Rock, Arkansas, on the 2nd day of April, 1962, asking the Board of Directors to vacate and abandon that portion of 29th Street between Ware and Bryant (Dunscomb) Streets and all of the alley in Block 5, Hamilton & Brack's Addition to the City of Little Rock, as designated on the plat of said Addition now-appearing of record in Plat Book 1, Page 175, in the office of the Recorder of Pulaski County, Arkansas, subject, however, to any public easements in said street and alley; and WHEREAS, after due notices as required by law, the Board of Directors has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the street and alley, hereinbefore described, have heretofore been dedicated to the public use as a street and alley, as herein described; have not been actually used by the public generally for a period of at least five (5) years subsequent to the filing of the plat; that all of the owners of the property abutting the street and alley to be vacated have filed with the Board of Directors their written consent to such abandonment; and that public interest and welfare will not be adversely affected by the abandonment of such street and alley; NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The City of Little Rock, Arkansas, hereby releases, vacates and abandons all its rights, together with C, —�Z the rights of the public generally, in and to the street and alley designated as follows: That portion of 29th Street between Ware and Bryant (Dunscomb) Streets and all the alley in Block 5, Hamilton and Brack's Addition to the City of Little Rock, Arkansas; provided however, that the rights now held by any public utility company under the laws of the State of Arkansas or under grants heretofore made by the City of Little Rock, to use the south half of 29th Street between Ware and Bryant (Dunscomb) Streets for the location and operation of equipment and facilities for the furnishing of public utility services shall not be abrogated, diminished or changed by the enactment of this Ordinance. SECTION 2. A copy of this Ordinance, duly certified by the City Clerk, shall be filed in the office of the Recorder of Pulaski County and recorded in the Deed Records of the County. SECTION 3.
