AN ORDINANCE VACATING, ABANDONING AND CLOSING AN
ALLEY RUNNING NORTH AND SOUTH THROUGH BLACK "A",
BEN COX SUBDIVISION OF LOT 39 BLACK.2, . HYDE PARK
ADDITION TO.LITTL.E ROCK, ARKANSAS:.AND FOR OTHER
PURPOSES..
WHEREAS, a petition was duly filed by all of the owners
of all property abutting the alley running North and South through
Block "A ", Bea Cox Subdivision of Lot 3, Block 2, Hyde Park Addition
to Little Rock, Arkansas, on the 20th day of June, 1962, asking the
Board of Directors to vacate and abandon all of said alley, which,
according to the official plat of record in Plat Book 2, Page 24,
in the office of the Recorder of Pulaski County, Arkansas, lies
and is situated between Seventeenth Street on the North, Eighteenth
Street on the South, Van Buren Street on the West and Jackson Street
on the East in Little Rock, Pulaski County, Arkansas, subject, how-
ever, to any public easements in said alley; and
WHEREAS, after due notice as required by law, the Board
of Directors has, at the time and place mentioned in the notice,
heard all persons desiring to be heard on the question and has
ascertained: that the said alley has heretofore been dedicated
to the public use as an alley; that said alley has not been actually
opened or used by the public since the filing of the plat; that
all of the owners of the property abutting upon the alley to be
vacated have filed with the Board of Directors their written con-
sent to such abandonment; and that public interest and welfare
will not be adversely affected by the abandonment of such alley;
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. The City of Little Rock, Arkansas, hereby
releases, vacates and abandons all its rights, together with the
rights of the public generally, in and to the alley designated as
follows:
An alley running North and South through Block "A ",
Ben Cox Subdivision of Lot 3, Block 2, Hyde Park .
Addition to the City of- .Little..Rock, Arkansas, Which,

provided,, however, that the rights now held by any public utility
company under the laws of the State of Arkansas or under grants
heretofore made by the City of Little Rock to use the alley
running north and south through Block A, Ben Cox Subdivision of
Lot 3, Block 2, Hyde Park Addition, for the location and operations
of its lines, circuits, and facilities for the furnishing of
public utility services shall not be abrogated, diminished, or
changed by the enactment of this ordinance.
SECTION 2. A copy of this Ordinance, duly certified by
the City Clerk, shall be filed in the office of the Recorder of
Pulaski County and recorded in the Deed Records of the County.
SECTION 3. This ordinance shall be in full force and
effect from and after its passage and approval.
