HomeMy WebLinkAbout11317. t ORDINANCE NO. 11,317 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF LITTLE ROCK BY ADDING AN ARTICLE ENTITLED "ARTICLE II. PAWNBROKERS AND DEALERS IN SECOND HAND GOODS ", REGULATING PAWNBROKERS AND DEALERS IN SECOND HAND GOODS; PROVIDING A PENALTY AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. That the Code of Ordinances of the City of Little Rock, Arkansas, is hereby amended by adding Article II to Chapter 21, which shall read as follows: "ARTICLE II. Pawnbrokers and Dealers in Second Hand Goods Sec. 21 -14. Definitions. The following definitions shall apply to the use of certain terms as used in this Article: a. Pawnbroker. A person, firm or corporation engaged in the business of lending money upon the security of goods deposited with it or left in pawn, with or without a fixed period of redemption, whether or not a fixed place of business is main- tained for such purposes. b. Goods. Any tangible chattel or personalty capable of physical delivery, except furniture and motor vehicles. The term furniture shall not include radios, television sets, appliances or other items with mechanical, electrical or electronic works. c. Dealer in Second Hand Goods. Any person, firm or corporation buying, selling, or otherwise dealing principally in used or second hand goods, and any person, firm or corporation who buys for resale any used or second hand goods, whether or not as a prin- ciple vocation or business, and without regard to whether or not such person, firm or corporation maintains a place of business for such purpose. This definition shall not include a licensed retailer of C -f� - 2 - new goods who shall, in the ordinary course of business, receive used or second hand goods only as a "trade -in" or as part consideration for pur- chases of new goods. Sec. 21 -15. Records. Every person, firm or cor- poration engaged in the business of a pawnbroker or as a dealer in second -hand goods shall keep a well bound record book or register which shall contain a copy of every pawn ticket or contract or Bill of Sale issued by said pawn- broker or dealer in second hand goods. The Chief of Police or his duly authorized agents shall be entitled to inspect said book or register at any reasonable time. Sec. 21 -16. Reports for Police Department. Every pawnbroker or second hand dealer shall daily enter on forms supplied by the Chief of Police, in chronological order, all transactions wherein and whereby it receives goods by pawn or pledge or purchases second hand or used goods and shall provide all pertinent information per- taining to the transaction to the Chief of Police. Each page or sheet aforementioned shall contain columns appro- priately entitled for the recording of such information as shall be required herein, and, specifically, shall con- tain columns entitled "AMOUNT LOANED ", "TICKET NUMBER ", "ARTICLE ", "DESCRIPTION OF ARTICLE ", "MARKS119 "NAME OF PARTY PLEDGING OR SELLING ", "METHOD OF IDENTIFICATION ", "ADDRESS" and "DESCRIPTION OF PERSON ", though other columns for pertinent information may be added or deleted from time to time. Sec. 21 -17. Contents of Reports. The information to be entered under the column titles shall be as follows: a. "AMOUNT LOANED ". In this column shall be entered the amount loaned against the article or - 3 - articles by the pawnbroker or paid for the article or articles by a pawnbroker or dealer in second hand goods. If the transaction is a purchase of goods the letter "P" shall be entered in the upper right hand corner of the block in this column used in recording the transaction. b. "TICKET NUMBER ". The entry in this column shall be the pawnticket number or redemption number issued to the pawnor and assigned to and tagged onto the goods. Dealers in second hand or used goods shall tag all items purchased with consecutively numbered tags and the number of such tags shall be entered in this column. c. "ARTICLE ". The entry in this column shall be a description of the class of goods within which the pawned or purchased item belongs. Examples are:. Projector, camera, shoes, revolver, typewriter, watch, ring, television, etc. It shall not be necessary to give a detailed description of such item or goods in this column. d. "DESCRIPTION OF ARTICLE ". Here a concise des- cription of the goods shall be given. In the case of all goods the size, color and descriptive char- acteristics most pertinent should be entered. Serial numbers of all appliances or mechanical, electrical, electronic or other manufactured goods shall be entered if such is available on said goods. Model or chassis numbers shall not be entered in lieu of a serial number unless there be no serial number. In the case of watches, the outside case number shall be sufficient if the watch is waterproof, but other- a - 4 - wise both the case number and movement number shall be given, if both are present. e. "MARKS ". In this column any identifying marks, initials, monograms or personalized features shall be entered to further describe the goods. f. "NAME OF PARTY PLEDGING OR SELLING ". Here shall be entered the name of the person presenting the goods for pawn or for sale. The name entered shall be substantiated and verified by the pawn- broker or dealer in second hand or used goods by examination of the driver's license or social security card of the pawnor or seller, unless the seller or pawnor shall be personally known by the pawnbroker or dealer in second hand goods, in which event an entry shall be made with the letters "pk" in the column described in sub- section g. hereof. R. 11MBOD OF IDENTIFICATION ". The entry here shall be the number appearing on the driver's license, social security card, or other identifi- cation source of the person pawning or selling goods, used for identification under the foregoing sub - section f. hereof. h. "ADDRESS ". The address of the person pawning or selling goods should be placed in this column. i. "DESCRIPTION OF PERSON ". A description of the person pawning or selling goods shall be made in this column indicating sex, race, age, height and weight. Sec. 21 -18. Duty to Retain Goods. No bond, security or goods of any kind whatsoever received on deposit, pur- chased or pledged to or by any pawnbroker or dealer in second hand goods shall be sold or permitted to be redeemed - 5 - or removed from the place of business of such pawnbroker or dealer in second hand goods for a period of thirty -six (36) hours from the time of receiving same. Sec. 21 -19. Notification to Police of Altered Serial Numbers. In the event any goods are pawned, pledged or sold, or tendered for pawn or sale to any person regulated by this ordinance, which normally carry or have a serial number or numbers or means of identification which shall have been removed, mutilated, defaced or destroyed, such fact shall be immediately reported by the pawnbroker or dealer in second hand goods to the Chief of Police or his duly authorized agents. Sec. 21 -20. Penalties. Any person, firm or cor- poration who shall willfully violate any provision hereof shall upon conviction thereof be deemed guilty of a mis- demeanor and shall be fined in a sum not less than Ten Dollars ($10.00) nor more than Fifty Dollars ($50.00) for each offense. Each and every article or item of goods acquired in violation hereof shall be deemed a separate violation hereof." SECTION 2. This ordinance shall be in full force and effect from and after its passage and approval. PASSED: October 1, 1962 ATTEST - APPROVED: City Clerk Mayor
