HomeMy WebLinkAbout11468ORDINANCE NO. 11,468 AN ORDINANCE VACATING, ABANDONING AND CLOSING WEST SIXTH STREET BETWEEN WOLFE STREET AND BATTERY STREET IN THE CITY OF LITTLE ROCK, ARKANSAS, AND OTHER PURPOSES. WHEREAS, a Petition was duly filed by the Housing Authority of the City of Little Rock, Arkansas, and the Arkansas Revenue Depart- ment Building Commission, Little Rock, Arkansas, with the Board of Directors of the City of Little Rock, Arkansas, asking the Board of Directors to vacate, abandon and close West Sixth Street between Wolfe and Battery Street, same being more particularly described in said Petition and hereafter; and WHEREAS, after due notice as required by law, the Board of Directors has, at the time and place mentioned in the Notice, heard all persons desiring to be heard on the question and has ascertained that West Sixth Street between Wolfe Street and Battery Street is no longer needed or required for corporate purposes or for use by the general public and adjoining owners in that other streets are available and used for these purposes, that Petitioner, Housing Authority of the City of Little Rock, Arkansas, is the only abutting landowner upon West Sixth Street between Wolfe Street and Battery Street, to be vacated and accordingly all abutting landowners have consented to such abandonment, and that the public interest and welfare will not be adversely affected by the abandonment thereof; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. The City of Little Rock, Arkansas, hereby releases, vacates and abandons all its rights, together with the rights of the public generally, in and to West Sixth Street between Wolfe Street and Battery Street, described as follows: OGO - "' 4 -/ "1 Ar it Page 2 West 6th Street between Wolfe Street and Battery Street, Little Rock, Arkansas, more particularly described as follows: Beginning at the Southwest corner of Block 22, FAUST'S ADDITION to the City of Little Rock; thence East along the North right -of -way line of West 6th Street to the Southeast corner of said Block 22; thence South to the Northeast corner of Block 15, FAUST'S ADDITION to the City of Little Rock; thence West along the South right -of -way line of West 6th Street to the South- west corner of said Block 15; thence North to the point of beginning; and that the ownership thereof except as to utility easements pro- vided for in Section 2 hereafter shall vest in said owner of the abutting property, Housing Authorityof the City of Little Rock, Arkansas. Section 2. The rights now held by any public utility company, under the laws of the State of Arkansas or under grants heretofore made by the City of Little Rock, Arkansas, to use West Sixth Street between Wolfe Street and Battery Street, as described above in Section 1, for the location and operation of lines and facilities for the furnishing of public utility services, shall not be abrogated, diminished or changed by the enactment of this Ordinance, and utility easements now in effect are specifically excepted from this closing. Section 3. A copy of this Ordinance, duly certified by the City Clerk, shall be filed in the office of the Recorder of Pulaski County, Arkansas, and recorded in the deed records of said County. Section 4. The redevelopment of the lands now owned by Petitioner, Housing Authority of the City of Little Rock, as part of its urban renewal project, will be seriously delayed if said street is not closed and vacated immediately, the redevelopment to be done by Petitioner, Arkansas Revenue Department Building Commissioner, as set forth in the Petition filed herein. An emergency is therefore � s Pa ge 3 declared to exist and this Ordinance being necessary for the immediate preservation of the public welfare shall take effect immediately upon its passage and approval.
