AN ORDINANCE AMENDING SUBPARAGRAPH (a) OF ITEM lr. OF SUBSECTION
(A) OF SECTION 22 -7 OF THE CODE OF ORDINANCES OF THE CITY OF
LITTLE ROCK, SAME REGULATING THE SALE OF MILK AND MILK PRODUCTS;
DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE
ROCK, ARKANSAS:
SECTION 1. Subparagraph (a) of Item 1r. of Subsection (A) of
Section 22 -7 of the Code of Ordinances of the City of Little
Rock regulating the sale of milk and milk products in the City
of Little Rock is hereby amended to read as follows:
" Item 1r. Cows -- Tuberculosis, Bang's disease, other diseases;
and certificates:
(a) Tuberculosis. A tuberculin test of all herds producing
Grade A raw milk for pasteurization shall be made before
any milk therefrom is sold, and shall be retested every
three years thereafter. All cattle 24 months of age or
older shall be included in the test, regardless of the
utilization of the milk. All cattle added to the herd
shall have passed a tuberculin test within three months
before being added to the herd and retested in not less than
sixty days, nor more than ninety days after being added to
the herd. If reactors are found, the herd shall be retested
as often as directed by the Health Officer and /or the State
Veterinarian. Tests and retests shall be made by an ac-
credited veterinarian or regularly employed veterinarian
of the Livestock and Poultry Commission and reactors dis-
posed of in accordance with requirements approved by the
Animal Disease Eradication Division, U.S. Department of
Agriculture and the Arkansas Livestock and Poultry Com-
mission. Every reactor and /or suspect shall be removed
from the herd at once, and no milk therefrom shall be sold
or offered for sale. Each animal tested shall be identified
by a numbered metal tag or tattoo mark and a certificate,
properly executed and legibly signed by the veterinarian
and filed as directed by the Health Officer, shall be the
only valid evidence of the test. The wording of, and in-
formation furnished by, the certificate shall meet the
approval of the Health Officer.
Provided, however, that in case of extreme shortage of
Grade A raw milk for pasteurization in Arkansas, and the
supply of Grade A raw milk for pasteurization is not avail-
able from other areas complying with a three -year tuberculin
testing program, the Health Officer having jurisdiction is
hereby authorized to permit the importation of Grade A raw
milk for pasteurization from other areas that are operating
under and complying with the tuberculin test requirements of
the current U.S. Public Health Service Ordinance and Code."
SECTION 2. It is found and determined that there is an extreme

shortage of raw milk products available to the public within the
City of Little Rock; that such shortage can be relieved in part
by adopting the U.S. Public Health Department's standards for
testing for tuberculosis at sources outside the State of Arkansas;
now therefore, an emergency is declared to exist and this ordinance
being necessary for the preservation of the public peace, health
and safety shall be in full force and effect from and after its
passage.
