HomeMy WebLinkAbout11411ORDINANCE NO. 11,411 AN ORDINANCE APPROPRIATING TEN THOUSAND TWO HUNDRED FIFTY AND N01100 DOLLARS ($10,250.00) FROM UNAPPROPRIATED SURPLUS IN THE STREET RIGHT -OF -WAY FUND, SAME BEING A PART OF THE 1958 BOND CONSTRUCTION FUND, FOR THE ACQUISITION OF CERTAIN RIGHT -OF -WAY WITHIN THE CITY OF LITTLE ROCK; AUTHORIZING THE CITY MANAGER TO PURCHASE CERTAIN REAL ESTATE NEEDED FOR RIGHT - OF -WAY PURPOSES; AUTHORIZING THE RAZING OR REMOVAL OF IMPROVE- MENTS LOCATED ON THE PROPERTY AFTER PURCHASE; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. There is hereby appropriated from unappropriated surplus in the Street Right -of -Way Fund, same being a part of the 1958 Bond Construction Fund, the sum of Ten Thousand Two Hundred Fifty and No /100 Dollars ($10,250.00) for the purpose of acquiring certain real estate for right -of -way purposes within the City of Little Rock, Arkansas. SECTION 2. The City Manager is hereby authorized and directed to purchase in the name of the City of Little Rock, Arkansas, from E. J. Calloway, Jr., and any others having title thereto, and subject to the approval of title by the City Attorney, the following described real estate situated in Little Rock, Pulaski County, Arkansas, to -wit: East 111 feet of Lot 7 and East 111 feet of South 2 feet of Lot 8, Block 239, Original City of Little Rock, Arkansas, for a total consideration of Ten Thousand Two Hundred Fifty and No /100 Dollars ($10,250.00). SECTION 3. The City Manager, upon receipt by the City of Little Rock of a Warranty Deed to the said property and the clearance of title thereto, may, at his election and option and in the exercise of his best judgment, arrange for the razing, removal or other disposition of the improvements erected upon the real estate described in Section 2 hereof in the least expensive method so as to make available, when needed, any or all of the said tract of land for right -of -way purposes in connection with the relocation and establishment of the proposed Wright Avenue Bypass Project. 000' 33 G —/A ob —2— SECTION 4. The City Manager and Director of Finance are hereby authorized and directed to issue the necessary warrant in payment of the purchase price authorized in the foregoing Sections hereof. SECTION S. WHEREAS, the facilities for truck traffic within the City of Little Rock, Arkansas, are inadequate and the current route for heavy trucks and other vehicles in and through the City of Little Rock, Arkansas, is creating a dangerous and hazardous condition thereby impairing the public health, safety and welfare; and WHEREAS, the new location of the right -of -way for Wright Avenue will alleviate unsafe traffic conditions now existing; NOW THEREFORE, an emergency is found to exist and this ordinance,being necessary to provide adequate facili- ties for the routing of heavy vehicles and truck traffic within.the City of Little Rock, Arkansas, thereby enhancing the public health, safety and welfare, shall be in full force and effect from and after its passage.
