HomeMy WebLinkAbout11676ORDINANCE NO. 11,676 AN ORDINANCE VACATING AND ABANDONING A PORTION OF OHIO STREET AND FOR OTHER PURPOSES. WHEREAS, a petition was duly filed with the Board of Directors of the City of Little Rock, Arkansas, on the 22nd day of September, 1965, asking the Board of Directors to vacate, discontinue and abandon the portion of Ohio Street described in said petition and herein- after described; WHEREAS, after due notices as required by law, the Board of Directors has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the portion of said street has heretofore been dedicated to the public use as a street herein described; that no part of said portion of Ohio Street is being used or is needed for corporate purposes and no part of said portion of Ohio Street is needed as a street or thoroughfare by the public generally or by anyone; that the owner of all the property abutting upon said portion of Ohio Street to be vacated, discontinued and abandoned has filed with the Board of Directors her written consent to such abandonment; and, that public interest or welfare will not be adversely affected by the abandonment of said portion of Ohio Street. NOW, THEREFORE, be it ordained by the Board of Directors of the City of Little Rock, Arkansas: Section 1. The City of Little Rock, Arkansas, hereby releases, vacates, discontinues and abandons all of its rights, together with the rights of the public generally in and to the portion of Ohio Street designated as follows: That portion of Ohio Street extending from the West line (extended Northerly) of Lot Three (3), Block One (1), RATTERREE'S FOREST PARK HIGHLAND'S ADDITION to the City of Little Rock, Pulaski County, Arkansas, Easterly One Hundred Fifty (150) feet,more or less, to the East line (extended Northerly) of Lot One (1), Block One (1), RATTERREE'S FOREST PARK HIGHLAND'S ADDITION to the City of Little Rock, except any portion thereof recently dedicated or now being dedicated as Bryant Street; provided, that the existing water line easement along the existing water line and other existing utility or sewer easements, if any, over and through said portion of Ohio Street vacated herein including the right to repair, replace and enlarge the same as future demands may require, shall not be changed or disturbed by this ordinance. Section 2. A copy of this ordinance duly certified by the City Clerk shall be filed in the office of the Recorder of Pulaski County, Arkansas, and recorded in the deed records of said County.
