HomeMy WebLinkAbout11598v' ORDINANCE # 11,598 ORDINANCE OF CITY OF LITTLE ROCK VACATING AND CLOSING A PORTION OF YOUNG ROAD, FROM MISSOURI PACIFIC RAILROAD EAST 695.1 FEET. WHEREAS, a petition was duly filed with the Board of Directors of Little Rock on the 22nd day of March , 1965, asking the Board of Directors to vacate and abandon the following portion of Young Road,.lying South of and adjacent to the North lines of SE 1/4 NW 1/4 and SW 1/4 NE 1/49 Sec. 36, Township 1 North, Range 13 West, Pulaski County; start at the Northwest corner of SW 1/4 NE 1/4, thence South 89 degrees 23 minutes 30 seconds West along the North line of SE 1/4 NW 1/4 33.3 feet to Easterly line of Missouri Pacific 100 foot right of way which is point of beginning, thence North 89 degrees 23 minutes 30 seconds East along the North lines of SE 1/4 NW 1/4 and SW 1/4 NE 1/4 695.1 feet, subject, however to any public easements in said street; and WHEREAS, after due notices as required by law the Board of Directors has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the portion of the street above described was dedicated to public use as a street but is a dead end and has not actually been used by the public generally for at least five (5) years; that the petitioner was the owner of all property surrounding the portion to be vacated and that the public interest will not be adversely affected: NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF LITTLE ROCK: SECTION 1. The City of Little Rock hereby releases and abandons all its rights, with the rights of the public generally in Young Road from the Missouri Pacific Railroad right of way for a distance of 695.1 feet east, as specifically described in paragraph one of the preamble hereto, subject, however, to any public utility easements thereon. SECTION 2. A certified copy of this ordinance shall be filed with the Pulaski County Recorder. 4 } SECTION 3 *;)This Ordinance shall take effect immediately upon passage and approval.
