LAND TAKEN AND DAMAGES TO REMAINING LANDS;
AND FOR OTHER PURPOSES.

' , the City of Little Mock has taken certain lands

for right -of -way purposes in connection with the widening of
University Avenue and has thereby incurred an indebtedness for
the value of the property taken and for injury and damage to
the remaining; parcel; and
+,;I3 "EREAS, said property, as more specifically described
below, is owned by Helen ose :ahn, Trustee, and that the said
Helen ;ose -ahn, Trustee, appears to be entitled to the said
damages to her property; and
R,iHE EAS, the City of Little Aock acknowledges that the
value of the land taken is Three Thousand Five Hundred and
No /100 Dollars ($3,500.00) and that the damage to the residual
land appears to be in the sum of Seven Thousand Five Hundred
and No /100 Dollars ($7,500.00); and
'i:`HE:'.EAS, there is a balance of Three Thousand Six Hundred
Seventy and 60 /100 :collars ($3,670.60) in the Street Hight- of -1-lay
Fund, Project 'Thirty -Nine (39), University Avenue Might- of -14ay,
which can be used for purposes of payment and that the sum of
Seven Thousand Three Hundred Twenty -Nine and 40/100 Dollars
($7,329.40) should be appropriated from unexpended balance in
the Street sight- of -v,Iay Fund to said Project 39 in order to pay
said damages;
NOW, THEREFO-tE, BE IT O DAINED BY THE BOA D OF DI�2ECTOAS
OF TH LZ CITY OF LITTLE 'IOCv_, ARKANSAS:
SECTION 1. There is hereby authorized payment to Helen
Rose Kahn, Trustee, for the value of certain lands taken by the

City of Little Rock for use in the widening and improving of
University Avenue the sum of Three Thousand Five Hundred and
No /100 Dollars ($3,500.00) in full and complete payment therefor
and there is further authorized payment in the sum of Seven
Thousand Five Hundred and No /100 Dollars ($7,500.00) for the
injury and damage to the residual lands remaining after the
taking, which payment likewise appears to be due to 'Helen dose
°ahn, Trustee. The land for which this payment is authorized
is Lot 4, Block 15, =andefur's Addition to the City of Little
'mock., a part of which was physically taken by the City of Little
and the damage to the residual of the tract relates to the
remaining part of Lot 4, "loci:. lo, and all of Lots 5, 6, 7, 8
and 9 of said Block 16 of Sandefur's Addition to the City of
Little 11,ock, Arl- Kansas, which is for these purposes deemed and
considered a -vfnole tract.
SECTIiN 2. There is hereby appropriated from unexpended
balance in the Street eight- of -Way Fund to Project 39 within
said fund for the -purpose of rain" the dama -es as describeG
more fully in Section 1 11ereof the sum of Seven Thousand Three
Hundred Twenty - 1,11ine and 40/100 1--ollars ($7,329.40).

appropriation herein is made shall be payable I., the City 1 ana -er

of a complete '- elease from any and all further claims which she
may have against the 'ity of Little rwck arising from the ta-.in;
of lands as above - described or the residual damage to the lands
remainin- after the ta'in-, or both, in such form as shall have
been approveG in advance by the office of the City Attorney and
upon the dismissal or a stipulation for dismissal of any and all
pending litigation between Helen lose i_ahn, Trustee, and the City
of Little ?ock arising; from the taking and damages of and to the
said lands.
