AN ORDINANCE AMENDING SECTION 107.2 OF ORDINANCE NO.
11,398, SAME BEING THE BUILDING CODE OF THE CITY OF
LITTLE ROCK; PROVIDING FOR INSPECTION FEES UNDER CER-
TAIN CIRCUMSTANCES AS DEFINED; DECLARING AN EMERGENCY;
AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK,
ARKANSAS:
SECTION 1. Section 107.2 of Ordinance No. 11,398, same being
the Building Code of the City of Little Rock, Arkansas, is hereby amended
by adding a Subsection (1) as follows:
11(1) In those instances where more than two (2) inspections
by the Building Official are necessary due to what is deter-
mined by the first and second inspections to be unsatisfactory
construction, an inspection fee in the amount of Three Dollars
($3.00) shall be assessed against the contractor or party
holding the building permit for each such additional inspection;
provided, however, where there is found to be evidence that such
unsatisfactory construction resulted by reason of an act of God
or through no fault of the contractor or owner, then no such
additional inspection fees shall be assessed regardless of the
number of inspections made."
SECTION 2. WHEREAS, it is found by the Board of Directors of
the City of Little Rock, Arkansas, that certain persons holding building
permits have called and continue to call for inspections although the
work to be inspected is incomplete or improperly done, resulting in the
necessity of two or more additional inspections at subsequent times; and
WHEREAS, it is found that the inspector's time and energies are wasted
due to the aforesaid conditions, thereby substantially interfering with
the proper functioning of building inspectors; and WHEREAS, it is found
that such condition is a detriment to the public health, safety and wel-
fare and may be eliminated only by providing for a penalty; now, therefore,
an emergency is found to exist and this ordinance being necessary for the
preservation of the public peace, health, safety and welfare shall be in
full force and effect from and after its passage.
