HomeMy WebLinkAbout11580ORDINANCE NO. 11,580 AN ORDINANCE PROVIDING FOR THE VACATION AND ABANDONMENT OF AN UNNAMED, UNUSED, UNIMPROVED STREET LYING BETWEEN BERRY STREET AND LEE AVENUE AND ABUTTING LOTS ONE . (1) .AND NINETEEN (19), BLOCK ONE (1), MIDLAND HILLS ADDITION TO THE.CITY OF LITTLE ROCK, ARKANSAS; RESERV- ING-CERTAIN UTILITY_ EASEMENTS; - REPEALING ORDI- NANCE 11,578;.AND.FOR OTHER PURPOSES. WHEREAS, a petition was filed on the 19th day of January, 19652 by the State of Arkansas seeking the abandonment and vacation of an unnamed, unused, unimproved street lying between Berry Street and Lee Avenue and abutting Lots 1 and 19, Block 1, Midland Hills Addition to the City of Little Rock, Arkansas, on the West and abutting the North 300 feet of the West 600 feet of the NWT NWT of Section 4, Township 1 North, Range 12 West, on the East, according to a plat filed for record on September 2, 1910, and appearing in Plat Book 1 at page 132, in the office of the Circuit Clerk and Ex- officio Recorder of Pulaski County, Arkansas; and, WHEREAS, a public hearing was held after due notice as required by law on March 15, 1965, to determine whether said street should be vacated and abandoned, at which hearing no property owners or other persons appeared to protest said abandonment; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. That the unnamed, unused, unimproved street lying between Berry Street and Lee Avenue in the City of Little Rock, according to a plat filed for record on September 2, 19102 and appearing in Plat Book 1 at page 132, in the office of the Circuit Clerk and Ex- officio Recorder of Pulaski County, Arkansas, is hereby closed, vacated and abandoned and gwnership of said property shall revert to the abutting landowner or landowners. L'GG 4 3 � -a -2- Reserved, however, from this closure, vacation and abandonment shall be an easement for the maintenance of public utilities lying within said street, which easement is described as follows: From the West side of the street East to a line parallel to the West line of said street, which line is twelve (12) feet East of the existing electric distribution circuit. SECTION 2. This ordinance shall be in full force and effect from and after its passage and approval, and Ordinance 11,578 is hereby repealed in its entirety.
