HomeMy WebLinkAbout11570i ORDINANCE NO. 11,570 AN ORDINANCE VACATING, ABANDONING AND CLOSING RINGO STREET BETWEEN WEST 13TH STREET AND WEST 14TH STREETS IN THE CITY OF LITTLE ROCK, ARKANSAS, AND OTHER PURPOSES. WHEREAS, a Petition was duly filed by the Housing Authority of the City of Little Rock, Arkansas, Collins and Rosie Tuggle, Ted E. Niehaus, William C. Brown, and Acme Laundry & Cleaners, with the Board of Directors of the City of Little Rock, Arkansas, asking the Board of Directors to vacate, abandon and close Ringo Street between West 13th and West 14th Streets, same being more particularly described in said Petition and hereafter; and WHEREAS, after due notice as required by law, the Board of Directors has, at the time and place mentioned in the Notice, heard all persons desiring to be heard on the question and has ascertained that Ringo Street between West 13th and West 14th Streets is no longer needed or required for corporate purposes or for use by the general public and adjoining owners in that other streets and alleys are available and used for these purposes, that Petitioners, Housing Authority of the City of Little Rock, Arkansas, Collins and Rosie Tuggle, Ted E. Niehaus, William C. Brown, and Acme Laundry & Cleaners are the only abutting landowners upon Ringo Street between West 13th and West 14th Streets to be vacated, and accordingly all abutting landowners have consented to such abandonment, and that the public interest and welfare will not be adversely affected by the abandonment thereof; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. The City of Little Rock,Arkansas, hereby releases, Page Two vacates and abandons all its rights, together with the rights of the public generally, in and to Ringo Street between West 13th and West 14th Streets, described as follows: Ringo Street between West 13th Street and West 14th Street, Little Rock, Arkansas, more particularly described as follows: Beginning at the Northwest corner of Block 269, Original City of Little Rock; thence South along the East right -of -way line of Ringo Street to the Southwest corner of said Block 269; thence West to the Southeast corner of Block 283, Original City of Little Rock; thence North along the West right -of -way line of Ringo Street to the Northeast corner of said Block 283; thence East to the point of beginning; and ownership thereof except as to utility easements provided for in Section 2 hereafter shall vest in the owners of the abutting property, Housing Authority of the City of Little Rock, Arkansas, Collins and Rosie Tuggle, Ted E. Niehaus, William C. Brown, and Acme Laundry & Cleaners, their heirs, successors or assigns. Section 2. The rights now held by any public utility com- pany, under the laws of the State of Arkansas or under grants heretofore made by the City of Little Rock,Arkansas, to use Ringo Street between West 13th and West 14th Streets as described above in Section 1, for the location and operation of lines and facilities for the furnishing of public utility services shall not be abrogated, diminished or changed by the enactment of this Ordinance, and utility easements now in effect are specifically excepted from this closing. Section 3. A copy of this Ordinance, duly certified by the City Clerk, shall be filed in the office of the Recorder of Pulaski County, Arkansas, and recorded in the deed records of said County. Page Three Section 4. The redevelopment of the lands now owned by Petitioner, Housing Authority of the City of Little Rock, as part of its urban renewal project, will be seriously delayed if said street is not closed and vacated immediately. An emergency is therefore declared to exist and this Ordinance being necessary for the immediate preservation of the public welfare shall take effect immediately upon its passage and approval. Section 5. All ordinances or parts of ordinances in conflict herewith are hereby repealed. PASSED: March 1, 1965 ATTEST: City Clerk APPROVED: Mayor
