HomeMy WebLinkAbout11796ORDINANCE NO. 11,796 AN ORDINANCE AUTHORIZING THE CONVEYANCE OF CERTAIN LANDS IN SECTION 34, TOWNSHIP 3 NORTH, RANGE 14 WEST, PULASKI COUNTY, ARKANSAS, WITH PURCHASE PRICE TO BE PAID TO BOARD OF COMMISSIONERS OF LITTLE ROCK MUNICIPAL WATER WORKS WHEREAS, the Board of Commissioners of the Little Rock Municipal Water Works, by resolution duly enacted on September 9 , 1966, requested the Board of Directors of the City of Little Rock, Arkansas, to approve the sale of the hereinafter described real property held in the name of the City of Little Rock, Arkansas, for the use and benefit of the Little Rock Municipal Water Works; and WHEREAS, said Board of Commissioners has determined that said sale will be to the best interest of the City of Little Rock; Nov. Therefore, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. That the Mayor and City Clerk of Little Rock, Arkansas, be, and they are hereby, authorized and directed to execute a quitclaim deed on behalf of the City of Little Rock, Arkansas, conveying to Dale M. Johnston, Gene Horsey and Hershal Moreland, as Trustees for Natural Steps Baptist Church, the following described real property situated in Pulaski County, Arkansas, to -wit: A tract of land in the NEk of Section 34, Township 3 North, Range 14 West, described as follows: Begin at the Northeast corner of the SEk of said NEk and run thence West along the North line thereof 354.2 feet to a point on the Northwesterly right of way line of Roland Road, as relocated; thence Southwesterly along said right of way line at an angle of 39 degrees 35 minutes to said North line 241.1 feet to a point on said right of way line 540 feet West of the East line of said SEk of the NE'k, which is the point of beginning; thence South 50 degrees 25 minutes West 100 feet; thence North 374.4 feet; thence East 77.1 feet; thence South 310.7 feet to the point of beginning, containing 0.39 acres, more or less, ':� — 3 for the sum of $275.00 cash payable to the Board of Commissioners of the Little Rock Municipal Water Works, subject to the following covenant and easement: By the acceptance of this deed, the grantees covenant for themselves, their successors and assigns, and for the Natural Steps Baptist Church and its members that if the premises hereby conveyed are ever flooded or damaged by overflow water from Lake Maumelle or from the spillway canal of Lake Maumelle or by reason of the existence, operation, construction or repair of Lake Maumelle, its dam or its spillway canal, neither the City of Little Rock nor the Little Rock Municipal Water Works nor the agents, contractors or employees of either shall ever be liable for said flooding or damages. Said covenant shall run with the land and the City of Little Rock and the Little Rock Municipal Water Works, their successors and assigns, shall have a perpetual easement to perform the acts aforesaid for which they are to be protected against liability by this instrument. SECTION 2. That this ordinance shall take effect and be in force from and after its passage. PASSED: September 19 , 1966. APPROVED: ATTEST: City Clerk RESOLUTION WHEREAS, the lands, of which the parcel described below is a part, were acquired for the City of Little Rock by the Board of Commissioners of the Little Rock Municipal Water Works in conjunction with the construction of Lake Maumelle; and WHEREAS, said lands were acquired for multiple purposes, to -wit: To permit the relocation of the Roland Road, to permit the construction of a spillway canal and to protect the Water Works from damage claims because of the possibility of overflow water from said canal and Lake Maumelle; and WHEREAS, said road and canal have now been constructed and the lands described below are no longer needed for waterworks purposes except for an overflow easement; and WHEREAS, said property has been valued at $150.00 by a professional appraiser employed by the Water Works; and WHEREAS, the Natural Steps Baptist Church has applied to purchase said property for the sum of $ 275.00 ; Now, Therefore: BE IT RESOLVED by the Board of Commissioners of the Little Rock Municipal Water Works that the Board of Directors of the City of Little Rock, Arkansas, be requested to authorize the sale of the following described real property, to -wit: A tract of land in the NEk of Section 34, Township 3 North, Range 14 West, Pulaski County, Arkansas, described as follows: Begin at the Northeast corner of the SEk of said NEk and run thence West along the North line thereof 354.2 feet to a point on the Northwesterly right of way line of Roland Road as relocated; thence Southwesterly along said righ of way line at an angle of 39 degrees 35 minutes to said North line 241.1 feet to a point on said right of way line 540 feet West of the East line of said SEk of the NEk, which is the point of beginning; thence South 50 degrees 25 minutes West 100 feet; thence North 374.4 feet; thence East 77.1 feet; thence South 310.7 feet to the point of beginning, containing 0.39 acres, more or less, to Dale M.
