AN ORDINANCE ANWING THE CODE OF ORDINANCES OF THE
CITY OF LITTLE ROCK, ARKANSAS BY ADDING THERETO A
SECTION 36 -34 WITHIN CHAPTER 36; PROVIDING FOR THE
PLANTING AND MAINTAINING OF TREES AND SHRUBS IN
CERTAIN PUBLIC RIGHT -OF -WAY UNDER CERTAIN CONDITIONS;
AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE
ROCK, ARKANSAS:
SECTION 1. The Code of Ordinances of the City of Little Rock,
Arkansas, is hereby amended by adding thereto a section 36 -34 which
section shall read as follows:
'Section 36 -34. Trees and Shrubs.
It shall be permissible to plant and maintain trees and
shrubs in public right -of -way between the property line
and the street curb line within Fire Zones 1 and 2, only
if pursuant to and under authority of the Board of
Directors, as expressed by the granting of a franchise
for such purposes.
a. Any owner or occupant so desiring to install trees
or shrubs between the property line and the curb
line shall apply to the City of Little Rock,
Arkansas, for a franchise for such purpose. The
application shall contain a drawing of the property
and affected right -of -way, showing the location of
all proposed planting, the method of installation,
types of tree, shrub or vegetation and the number
of plants. Upon a finding by the Board of Directors
that such planting of trees or shrubs, or both, is
not contrary to the public interest and would not
cause injury or impairment to existing improvements
or to impair flow of vehicular or pedestrian traffic,
the Board of Directors may award a franchise in its
sole discretion.
b. Any franchise so issued shall be subject to revocation
by the Board of Directors at any time upon a finding
by the Board:-of Directors that any trees or shrubs,
or both, are interfering with public use of the right -
of -way, or are causing physical injury to utilities
or other improvements in the vicinity or are not
being maintained in a clean, neat, and attractive
manner. In the event of any revocation the owner
or person occupying the adjacent premises shall
remove any planting and shall restore the right -of-
way to its condition prior to the grant of the
franchise at the sole expense of the owner or
occupant and at no expense to the City of Little
Rock.
SECTION 2. It is found that new structures are
currently being erected in Little Rock, Arkansas within Fire
Zones 1 and 2 and that the builders are unable to provide adequate
landscaping under present law, and it being further found that
beautification of the downtown and other commercial .

areas is beneficial to the public health and welfare and that
this ordinance is necessary to permit same, an emergency is hereby
declared to exist and this ordinance shall be in full force and
effect immediately upon its passage and approval. All ordinances
and parts of ordinances in conflict herewith are repealed only to
the extent of such conflict.
