ORDINANCE NO. 11,704
AN ORDINANCE CONDEMNING CERTAIN PARCELS OF REAL
PROPERTY WITHIN THE PROPOSED EAST -WEST EXPRESSWAY
TO BE USED FOR THE PURPOSE OF CONSTRUCTING AN
EXPRESSWAY AND RELATED DRAINAGE FACILITIES;
DIRECTING THE CITY ATTORNEY TO INSTITUTE PROPER
CONDEMNATION PROCEEDINGS TO CARRY OUT THE INTENT
AND PURPOSES HEREOF; AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE
ROCK, ARKANSAS:
SECTION 1. The City of Little Rock does hereby condemn
for street right -of -way and drainage facilities the following
described parcels of real property situated in the City of
Little Rock, Arkansas:
A. Part of Lots 7, 82 9, and 10, Block 1, Roots &
Coys Addition, City of Little Rock; Described:- -
Beginning at the Northeast corner of Lot 10;
thence Westerly along the North line of Lot
10,80.77 feet; deflect 69026' left, thence
56.7 feet; deflect 119050' left, thence 102.23
feet; deflect 81003' left, thence 36.65 feet
to point of beginning; containing 3,915 square
feet, more or less, situated in Section 4,
Township 1 North, Range 12 West, which prop-
erty appears to be owned by Wholesale Appliance
Company.
B. A part of NWk SW'k Section 4, Township 1 North,
Range 12 West, more particularly described as
follows: -- Beginning at a point on the West line
of Thyer Street which is the Southeast corner
of said NWk SW'k, Section 4, which is also 167.8
feet north of intersection of West line of Thyer
Street and North line of 9th Street, thence run
North along West line of Thyer Street a distance
of 178.0 feet to a point which is 56.5 feet
distance Southeasterly, measured at right angles
to center line of main tract of Chicago Rock
Island & Pacific Railroad Company, thence run
Southwesterly parallel to and 56.5 feet South-
easterly from center line of said main line
tract a distance of 194.4 feet to a point on
South line of NWk SW'k of said Section 4, thence

J. A parcel of land situated in Section 4, Town-

Extension Addition to the City of Little Rock.
Commencing at the southwest corner of Lot 4;
thence northerly along the west line of Lot 4,
53.62 feet to the point of beginning; deflect
90027' right, thence 15.24 feet; deflect 152019'
left, thence 17.28 feet; deflect 118008' left,
thence 8.03 feet to the point of beginning;
containing 61 square feet, more or less, which
property appears to be owned by Reece Witherspoon
and wife, Laura Witherspoon.
L. South 52.7 feet of Lots 3 and 4, Block 16,
Capitol Hill Extension Addition, City of Little
Rock, which property appears to be owned by
Harry M. Wright and wife, Grace N. Wright.
The aforesaid properties are necessary to be utilized
in the construction and improving of an expressway in the City of
Little Rock and to provide for necessary storm drainage in rela-
tion thereto and for other related uses.
SECTION 2. The City Attorney, upon being advised by
the City Manager that further negotiations with the property
owners of the foregoing tracts have been terminated, is hereby
authorized and directed to file in the proper Courts proceedings
for the condemnation of the properties described in Section 1
hereof and to secure an Order of such Court allowing the City
to take immediate possession of the properties described upon
its posting bond in an amount to be detercmed by the Court and
to do any and all other things reasonably necessary in obtaining
immediate possession of said properties.
SECTION 3. Whereas the condition of thoroughfares and
required traffic facilities for East -West traffic within the City
of Little Rock are inadequate to sustain the flow of traffic
within this City, thereby causing congestion of traffic on the

existing streets,and whereas the proposed East -West Expressway
is designed to relieve the aforesaid congestion of vehicular
traffic, thereby enhancing the welfare, health and safety of the
citizens of this City; now, therefore, an,emergency is hereby
found to exist and this ordinance being necessary in the imple-
mentation and construction of adequate facilities for East -West
traffic, the same shall upon its passage and approval become
immediately effective.
