V 9 co M v k oT z�. m ra m 0, OADINANCE NO. 119948 AN ORDINANCE CONDETMIIG CERTAIN PARCELS OF REAL PROPERTY WITHIN THE PROPOSED ?MIGHT -OF- WAY FOR THE RE- CONSTRUCTION AND IMPROVING OF 65TII STREET INCLUDING WITHOUT LI1ITATION STORtl DRAINAGE FACILITIES; DIRECTING THE CITY ATTORNEY TO INSTITUTE CONDEMNATION PROCEEDINGS; AND FOR OTHER PURPOSES. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. The City of Little Rock does hereby condemn for street right -of -way and related drainage facilities purposes the following parcels of real property situated in the City of Little Rock, Pulaski County, Arkansas, to -wit: (1) A parcel of land situated in Leigh - Butler Acres, City of Little Rock, Pulaski County, Arkansas, more particularly described as follows: Part of Tract 24, Leigh - Butler Acres, commencing at the southeast corner of Tract 24, thence N 002711211 E, 218.61 feet to the point of beginning, thence N 0 °2711211 E, 135.80 feet; thence N, 89 °3212711 W 10.00 feet; thence S 0 °2715411 W, 60.00 feet; thence S 3 05211511 W, 76.06 feet; thence S 89 °23109" E, 14.51 feet to the point of beginning; containing 1,529 square feet, more or less. (2) A parcel of land situated in Leigh - Butler Acres, City of Little Rock, Pulaski County, Arkansas, more particularly described as follows: Part of Tract 24, Leigh- Butler Acres, beginning at the southwest corner of Tract 24; thence N. 0 °15131?? W, 19.93 feet; thence N. 84 016128'? E, 320.19 feet to the point of beginning, con- taining 18,297 square feet, more or.less. - 2 - (4) A parcel of land situated in Leigh - Butler Acres, City of Little Rock, Pulaski County, Arkansas, more particularly described as follows: Part of Tract 14, Leigh - Butler Acres, beginning at the southeast corner of Tract 14; thence N. 00 13110" W, 12.00 feet; thence 89052'25" W, 270.32 feet; thence S. 007'48" W, 12.00 feet; thence S. 89054155f, W, 270.40 feet to the point of beginning, containing 3,244 square feet, more or less. (5) A parcel of land situated in Leigh - Butler Acres, City of Little Rock, Pulaski County, Arkansas, more particularly described as follows: Part of Tract 17, Leigh - Butler Acres, beginning at the northeast corner 8f Tract 17; thence S. 10 50151" E, 20.20 feet; thence N. 89 29122" W, 323.93 feet; thence N. 1043137" W, 18.09 feet; thence S. 890511561' E, 323.86 feet to the point of beginning, containing 6,217 square feet, more or less. (6) A parcel of land situated in Leigh - Butler Acres, City of Little Rock, Pulaski County, Arkansas, more particularly described as follows: Part of Tract No. 23, Leigh- Butler Acres, beginning at the northeast corner of Tracg No. 23; thence South 1043137" East 18.09 fRet; thence North 89 25139" West 521.12 feet; thence North 38'5615711 East 17.32 feet; thence South 89 0 5115611 East 510.38 feet to the point of beginning, containing 9,131 square feet, more or less. The aforesaid parcels of real property are needed to be utilized as right -of -way in the construction and re- construction of 65th Street in the City of Little Rock and to provide for necessary storm drainage related thereto. SECTION 2. The City Attorney is hereby authorized and directed to file in the proper court proceedings for the condemnation of the property described in Section 1 hereof and to secure an order of such court permitting the City to take immediate possession of said property upon posting a bond in an amount to be determined by the court and to do any and all other things necessary in order to obtain immediate possession of said property. SECTION 3. Sixty -fifth (65th) Street in its present condition is inadequate to accomodate the flow of vehicular traffic utilizing and attempting to utilize said street thereby causing congestion of traffic thereon and on streets adjacent thereto; and the proposed improvement of said street is designed to relieve the congestion of traffic thereby enhancing the health, peace and safety of the citizens of the City of Little Rock. Now, therefore, an emergency exists and this Ordinance being necessary to protect i -3- the health, peace and safety shall become effective immediately upon its passage.
