HomeMy WebLinkAbout11910j ORDINANCE NO. 11,910 AN ORDINANCE ACCEPTING THE BID OF AND AUTHORIZING A CONTRACT WITH BITUMINOUS, INC., IN THE AMOUNT OF $23,734.70 FOR RECONSTRUCTION OF GEYER SPRINGS ROAD AT THE MISSOURI PACIFIC RAILROAD CROSS- ING IN THE CITY OF LITTLE ROCK; APPROP- RIATING THE SUM OF $23,734.70 FROM THE UNAPPROPRIATED BALANCE OF THE STREET FUND TO GEYER SPRINGS ROAD RAILROAD CROSSING PROJECT; AND FOR OTHER PUR- POSES. WHEREAS, invitation to bid was published for the reconstruction of Geyer Springs Road at the Missouri Pacific Railroad crossing in the City of Little Rock, bids were received pursuant thereto according WHEREAS, the lowest responsible and was that of Bituminous, Inc. in the amount of Thousand Seven Hundred Thirty Four and 70/100 ($23,734.70); and Arkansas and to law; and responsive bid Twenty Three Dollars WHEREAS, it is the desire of the Board of Directors to accept the bid of Bituminous, Inc. and authorize execution of a contract for such construction. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. The bid of Bituminous, Inc. in the amount of Twenty Three Thousand Seven Hundred Thirty Four and 70 /100 Dollars ($23,734.70) for the reconstruction of a portion of Geyer Springs Road at the Missouri Pacific Railroad crossing in the City of Little Rock, Arkansas is hereby accepted and the Mayor and City Clerk are hereby authorized and directed to execute a contract for and on behalf of the City of Little Rock with the said Bituminous, Inc. for the performance of the work in full compliance with plans, specifications and bid proposal on file in the office of the Purchasing Agent, which contract shall be in form and substance as follows: n -q C O N T R A C T THIS CONTRACT 1,ND AGREEMENT, made and entered into this day of , 19_ , by and between Party of the First Part; and Party of the Second Part, 1',7ITNESSETH: That for and in consideration of the payment to be made as hereinafter set forth, the Party of the First Part hereby agrees to furnish all tools, labor, equipment, and materials, and to build and construct in exact accord with the Plans on file in the office of the _ Little Rock, Arkansas, designated as _ _, and with the copy of said Plans, Specifications, and Proposal being attached hereto and made a part hereof as fully as though copied in full herein, under the direct supervision, and to the entire satisfaction of the subject to inspection at all times in accordance with the laws of the State of Arkansas. It is agreed and understood between the parties hereto that the Party of the First Part agrees to accept and the Party of the Second Part agrees to pay for the work at the prices stipulated in said Proposal, such payment to be in lawful money of The United States, and the payment shall be made at the time and in the manner set forth in the Specifications. The Party of the First Part agrees, for the consideration above expressed, to begin work within ten days after being ordered to begin work by the Engineer, and to complete the work within _ ___ (_ _) days. If the Party of the First Part shall fail to complete the work in the time herein specified, he shall pay to the Party of the Second Part, as liquidated damages, ascertained and agreed, and not in the nature of a penalty, the sum of _ _ ($ ) for each day delayed, which shall be deducted from the final amount of estimate made by the Contractor. The City Manager and Director of Finance are hereby authorized and directed to pay the contract price herein provided for in keeping with the terms and provisions of the said contract as and when said work is prosecuted in accordance with plans, specifications and bid proposal. SECTION 3. There is hereby appropriated from the unappropriated balance in the street fund the sum of Twenty Three Thousand Seven Hundred Thirty Four and 70/100 Dollars ($23,734.70) to the Geyer Springs Road Railroad Crossing Project to be used for paying the contract price herein pro- vided for.
