HomeMy WebLinkAbout11909ORDINANCE NO. 11,909 AN ORDINANCE CLOSING AND VACATING A PORTION OF THOSE STREETS DEDICATED AND DESIGNATED AS "ROCKEFELLER AVENUE" AND "WEST AVENUE" IN PLAT OF ARKANSAS HEIGHTS ADDITION, PULASKI COUNTY, ARKANSAS, AND ALLEYS RUNNING THROUGH BLOCKS 1 AND 2 OF SAID FORMER SUBDIVISION. WHEREAS, Dawlin C. Ellis, Joan Marie Ellis, W. Jake Brown, Odeal Brown, E. J. Walter, Jr. and Jacqueolyn Lou Walter filed a petition with the Board of Directors of the City of Little Rock, Arkansas, asking the Board to close, vacate and abandon the following portions of streets and alleys now situated in the City of Little Rock, Pulaski County, Arkansas, to -wit: and 1) All those portions of streets dedicated and designated as "Rockefeller Avenue" and "West Avenue" on the plat for ARKANSAS HEIGHTS ADDITION, Pulaski County, Arkansas, recorded in Plat Book 1 at Page 53 in the office of the Recorder for Pulaski County, Arkansas, which lie South of a line which is 30 feet South of, and parallel to, the centerline of the pavement of West Markham Street and which lie North of the North line of a street dedicated and designated as "Second Street" on the said plat for ARKANSAS HEIGHTS ADDITION, EXCEPT that portion of "West Avenue" which lies within 60 feet of the North line of the SEk of the NW'k of Section 3, Town- ship 1 North, Range 13 West, Pulaski County, Arkansas; and 2) All of those alleys which were dedicated by the plat for ARKANSAS HEIGHTS ADDITION, recorded in Plat Book 1 at Page 53 in the office of the Recorder for Pulaski County, Arkansas, and shown on said plat as running East and West through Blocks 1 and 2 of said Addition; WHEREAS, after due notice as required by law, the Board of Directors has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the petitioners are the owners of all property abutting upon the portions of the streets and alleys to be C G," _ s'6 N r closed; that the petitioners, by their petition, have consented to the vacation of the streets and alleys; that the portions of the streets and alleys to be closed are not required for public purposes and have not been actually used by the public for a much greater period than five years if, in fact, they were ever so used; and that the public interest and welfare will be benefited by the abandonment of such portions of the streets and alleys; Now, Therefore, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. The City of Little Rock, Arkansas, hereby releases, vacates and abandons all its right, together with the right of the public generally, in and to the following described portions of streets and alleys now situated in the City of Little Rock, Pulaski County, Arkansas, to -wit: 1) All those portions of streets dedicated and designated as "Rockefeller Avenue" and "West Avenue" on the plat for ARKANSAS HEIGHTS ADDITION, Pulaski County, Arkansas, recorded in Plat Book 1 at Page 53 in the office of the Recorder for Pulaski County, Arkansas, which lie South of a line which is 30 feet South of, and parallel to, the centerline of the pavement of West Markham Street and which lie North of the North line of a street dedicated and designated as "Second Street" on the said plat for ARKANSAS HEIGHTS ADDITION, EXCEPT that portion of "West Avenue" which lies within 60 feet of the North line of the SEk of the NWk of Section 3, Town- ship 1 North, Range 13 West, Pulaski County, Arkansas; and 2) All of those alleys which were dedicated by the plat for ARKANSAS HEIGHTS ADDITION, recorded in Plat Book 1 at Page 53 in the office of the Recorder for Pulaski County, Arkansas, and shown on said plat as running East and West through Blocks 1 and 2 of said Addition. Section 2. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the office of the Recorder and - 2 - ti recorded in the Deed Records of Pulaski County, Arkansas. Section 3. Whereas the existence of the hereinabove described portions of streets and alleys is adverse to the public interest and welfare, an emergency is declared to exist and this ordinance -shall take effect and be in force from and after its passage.
