SITUATED ON THE ARKANSAS RIVER; DIRECTING THE CITY ATT- ORNEY TO INSTITUTE CONDEMNATION PRO- CEEDINGS A" NST SAID PARCELS OF REAL. PROFERTY; REPEALING- ORDINANCE NO. 11,874; AND FOR OTHER PHASES. - NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. The following described parcels of real property situated in Pulaski County, Arkansas are hereby condemned for the purpose of providing street or roadway right -of -way upon, over and across parcels numbering One (1) through Five (5) and street or roadway and railroad right - of -way upon, over and across parcels numbering Six (6) and Seven (7) all to serve the Port of Little Rock situated on the Arkansas River and the City Attorney is hereby ordered and directed to file in the proper courts condemnation pro- ceedings against the following described parcels of real property situated in Pulaski County, Arkansas: (1) Lot 15, Block H. Factoria Addition to the City of Little Rock, Arkansas. Said property appears to be owned by Jerrell Eddy and his wife Louise. (2) Lot 18, Block H. Factoria Addition to the City of Little Rock, Arkansas. Said property appears to be owned by Arthur Brasfield and his wife. (3) Lot 20, Block H. Factoria Addition to the City of Little Rock, Arkansas. Said property appears to be owned by Oscar Thomas and his wife Bessie. (4) Lot 21, Block H. Factoria Addition to the City of Little Rock, Arkansas. Said property appears to be owned by Earvin Wyllia and his wife. r— 13 -2- (5) Lot 22, Block H. Factoria Addition to the City of Little Rock, Arkansas. Said property appears to be owned by Carroll Wilson and his wife. (6) A parcel of land situated in the SE*, WAS the NE-t, SE's, Section 16, and the Si*, Wk, - Section 15,,,,T-1-N. R -11 -W, of the 5th Principal Meridian, Pulaski County, Arkansas, and more particularly described as follows: Commencing at the Northwest corner of thee, SEA, Section 16, T -1 -N, A -11 -W; thence N 41•30t56" E 68.15 feet to the point of beginning, said point being on the West line of said SE *, NE-t, Section 16; thence N 78•43t34w E 2,080.56 feet; thence S 75055t4l" E 422.25 feet; thence S 37007142" E 43.61 feet; thence S 78043134" W 2,531.12 feet; thence N 01 030156" E 225.60 feet to the point of beginning gad containing 11.78 acres, more or less. (7) A parcel of land situated in the NW's. Section 15, T -1 -N, R -11 -W, of the 5th Principal Meridian, Pulaski County, Arkansas, and more particularly described as follows: Commencing at the Northwest corner of the NE's, WAS Section 16, T -1 -N, R -11 -W; thence S 01.30156" W - 157.45 feet; thence N 78.4313411 E 2,531.12 feet, thence S 37007142" E 44.46 feet; thence N 78 043134" E 238.91 feet to the point of beginning; thence N 37.07142" W 284.48 feet; thence S 75.55t41" E 116.29 feet; thence N 36043156" W 172.50 feet; thence N 43 016148" W 195.73 feet; thence N 39047159" W 37.06 feet; thence N 30.06150" E 327.91 feet to a point on the conterline�of Fourche Creek; thence S 16 003114" E 371.64 feet along said centerline of Fourche Creek; thence S 31022139" E 410.98 feet along said centet- line of Fourche Creek; thence S 42.13145" E. 58.79 feet along said centerline of Fourche Creek; thence S 78043134" W 204.65 feet to the point of beginning and eontaining 3.08 acres, more or less. The properties hereinabove described are necessary for the purpose of providing street or roadway right -of -way upon, over and across parcels "numbering Sne(1) through Five (5) and street or roadway and railroad right -of -way upon, over and across parcels numbering Six (6) and Seven (7) all to be constructed and maintained to serve the Port of Little Rock to be situated on the Arkansas River. SECTION 2. The City Attorney is further authorized to secure an Order of the Court allowing the City to take -3- immediate possession of the properties hereinabove described upon the posting of a bond in an amount to be determined by the Court. The City Attorney is authorized to have posted on behalf of the City a bond in an amount to be determined by the Court pending final determination of the condemnation proceedings. SECTION 3. Ordinance No. 11,874 passed April 17, 1967 is hereby repealed. SECTION 4. It is hereby found and determined that immediate possession and control of the property described by this Ordinance is necessary to enable the City to maintain the time schedule heretofore established for construction of the Terminal Facilities for the Port of Little Mock and that failure to maintain this time schedule can be detatafttal to the welfare of citizens of this city; that an emergency is declared to exist, and this Ordinance being necessary for the protection of the public welfare shall be in full force and effect from and after its passage.
