AN ORDINANCE CONDEMNING CERTAIN LANDS
LOCATED IN THE CITY OF LITTLE ROCK FOR
STREET - RIGHT -OF -WAY TO BE USED FOR THE
IMROVEl!+TT AND CONSTRUCTION OF ASHES
AVENUE IN THE CITY OF LITTLE ROCK; DIR-
ECTING THE CITY ATTORNEY TO INSTITUTE
PROPER CONDEbBATION PROCEEDINGS TO
CARRY OUT THE INTENT AND PURPOSE HEREOF;
AND FOR OTHER PURPOSES,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS.
SECTION 1. The City of Little Bock does hereby
condemn for right -of -way and storm drainage purposes the
following described parcel of real property situated in
the City of Little Rock, Arkansas:
A part of the East -Half of the West -Half of
the Southwest Quarter, Section 18, T -1 -N,
R -12 -W, more particularly described as follows:
Beginning at an iron pin which is at the point
where the West line of the East -Half, West -Half,
Southwest garter, Section 18, T -1 -U, R -12 -W,
crosses the present South right- of-way line of
U.S. Highway 67 -70, thence rein South along said
West line 242 feet to an iron pin, thence run N.
78!36t E. 298 -9 feet to an iron pin; thence rein
N. -10021 W. 65.0 feet to an iron pin; thence
continuing along said line N. 10021 W. 188.1
feet to an iron pin and the point of beginning
thence continuing along said line N. 10021 W.
20.8 feet to the present South right -of -way line
of U.S. Highway 67 -70 and an iron pin; thence
run S. 720341 W. along said South right -of -way
line 184.9 feet to an iron pin; thence S. O'llt
E. 17.3 feet to an iron pin; thence N. 72 °06+t E.
167.4 feet to an iron pin; thence N. 88.31♦ E.
17.4 feet to an iron pin and the point of beginn-
ing; containing 0.07 acres, more or less.
The aforesaid lands are necessary to be utilized
in the construction and improving of Asher Avenue in the
City of Little Bock and to provide for necessary storm
drainage and related facilities.
SECTION 2. The City Attorney is hereby authorized
and directed to file in the proper court proceedings for the
condemnation of the properties described in Section 1 hereof

and to secure an order of such court allowing the City
to take immediate possession of the properties described
upon its posting bond in an amount to be determined by the
court and to do any and all other things reasonably nec-
essary in obtaining immediate possession of said lands.
SECTION 3. %HMW, it is found and determined
that an unsafe condition exists on Asher Avenue adjacent
to the property hereinabove described in so far as the
safe movement of vehicular traffic is conderned and that
said unsafe condition can be corrected by the Widening and
improving of Asher Avenue following the acquisition of
right -of -way hereinabove described thereby enhancing public
peace, health and safety of the citizens of this community.
Therefore, an emergency is hereby found to exist and this
Ordinance being necessary in the implementation and con-
struction of adequate facilities for the safe movement of
vehicular traffic along Asher Avenue shall be in full force
and effect from and after its passage.
