FOR CONSTRUCTION OF FIRE STATION NO. 17 IN THE INDUSTRIAL AREA; APPROPRIATING THE SUM OF $60,000.00 FROM THE 1965 CAPITAL IMPROVEMENT CONSTRUCT- ION FUND; AUTHORIZING THE EXECUTION OF A CONTRACT; AND FOR OTHER PURPOSES. WHEREAS, invitation to bid was duly advertised and bids recieved pursuant thereto for Fire Station No. 17 according to plans and specifications prepared by Dan Cowling and Associates, Architects; and WHEREAS, the lowest responsible and responsive bid was that of James H. Cone, Inc. in the sum of Fifty Five Thousand and Two Hundred and Eighty Eight Dollars ($55,288.00); and WHEREAS, it is the desire of the Board of Directors to enter into a contract for said construction with James H. Cone, Inc. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. The bid of James H. Cone, Inc. in the sum of Fifty Five Thousand and Two Hundred and Eighty Eight Dollars ($55,288.00) for the construction of Fire Station No. 17 in accordance with plans and specifications prepared by Dan Cowling and Associates, Architects, is hereby accepted and the Mayor and the City Clerk are hereby authorized and directed to execute for and on behalf of the City a contract with said James H. These form the Contract, and all are as fully a part of the Contract as if attached to this Agreement or repeated herein. An enumeration of the Contract Documents appears in Article 8. ARTICLE 2 THE WORK The Contractor shall perform all the Work required by the Contract Documents for (Here insert the caption descriptive of the Work as used on other Contract Documents.) FIRE STATION NOS 17 DOYLS SPRINGS ROAD LITTLE ROCK, ARKANSAS ARTICLE 3 ARCHITECT The Architect for this Project is DAN COWLING AND ASSOCIATES, ARCHITECTS ARTICLE 4 TIME OF COMMENCEMENT AND COMPLETION The Work to be performed under this Contract shall be commenced upon written notice to proceed andcompleted within 120 consecutive calendar days, (Here insert any special provision, for liquidated damages relating to f,idure to complete on time.) As pointed out in Form of Bid, the bidder hereby agrees that the Owner may retain the sum of Fifty Dollars ($50,00 from the amount of compensation to be paid the undersigned for each day after the above mentioned completion date, Sundays and holidays included, that the work remains incomplete. FIFTY -FIVE THOUSAND, TWO HUNDRED EIGHTY «EIGHT AND no /100 DOLLARS BASE BIDo „o o$55,288,00 ARTICLE 6 PROGRESS PAYMENTS Based upon Applications for Payment submitted to the Architect by the Contractor and Certificates for Payment issued by the Architect, the Owner shall make progress payments on account of the Contract Sum to the Contractor as pro- vided in the Conditions of the Contract as follows: On or about the tenth (10th) day of each month ninety (90) per cent of the proportion of the Contract Sum properly allocable to labor, materials and equipment incorporated in the Work and ninety (90) per cent of the portion of the Contract Sum properly allocable to materials and equipment suitably stored at the site or at some other location agreed upon in writing by the parties, up to the twenty —fifth (25th day of that month, less the aggregate of previous payments in each case,- and upon Substantial Completion of the entire Work, a sum sufficient to increase the total payments to ninety (90) per cent of the Contract Sum, less such retainages as the Architect shall determine for all incomplete Work and unsettled claims. (Here insert any provisions made for limiting or reducing the amount retained after the Work reaches a certain stage of complelion.) There is hereby appropriated from the 1965 Capital Improvement Construction Fund to Project 52 - Fire Station No. 17 - Industrial Area - the sum of Sixty Thousand Dollars ($60,000.00) for the purpose of paying the contract price herein provided for and the cost of site improvement for said Fire Station and Architect fees.
