HomeMy WebLinkAbout12091ORDINANCE NO. 129091 AN ORDINANCE VACATING, ABANDONING AND CLOSING CERTAIN ALLEYS LOCATED IN THE HIGH STREET URBAN RENEWAL PROJECT, PROJECT NO. ARK R -6, IN THE CITY OF LITTLE ROCK, ARKANSAS WHEREAS, a Petition was duly filed by the Housing Authority of the City of Little Rock, Arkansas, and Philander Smith College, with the Board of Directors of the City of Little Rock, Arkansas, asking the Board of Directors to vacate, abandon and close certain alleys located in the High Street Urban Renewal Project, No. ARK R -6, in the City of Little Rock, Arkansas, which alleys were described in said Petition and are hereinafter set forth; and WHEREAS, under the provisions of Resolution No. 2601, duly adopted by the Board of Directors of the City of Little Rock, Arkansas, on November 21, 1960, the Urban Renewal Plan of the Housing Authority of the City of Little Rock, Arkansas, for the High Street Urban Renewal Project, Project No. ARK R -6, was formally approved, which plan included the closing of the subject alleys, hereinafter specifically described; and WHEREAS, after due notice as required by law, the Board of Directors has, at the time and place designated in the Notice, heard all persons desiring to be heard on the question and has ascertained that certain alleys hereinafter described are no longer needed or required for corporate purposes or for use by the general public; that Petitioners, Housing Authority of the City of Little Rock, Arkansas, and Philander Smith College, are the only abutting landowners upon the alleys to be closed in these proceedings, and accordingly all abutting landowners have consented to such abandon- 4 t Page 2 ment, and that the public interest and welfare will not be adversely affected by the abandonment thereof. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. That the rights now held by any public utility company, under the laws of the State of Arkansas or under grant heretofore made by the City of Little Rock, Arkansas, to use the alleys described above in Section 1, shall not be abrogated, diminished or changed by the enactment of this ordinance, and utility easements now in effect are specifically excepted from this closing. Section 3. A copy of this ordinance, duly certified by the City Clerk,shall be filed in the office of the Recorder of Pulaski County, Arkansas, and recorded in the deed records of said County. Section 4. The redevelopment of the lands now owned by Petitioner, Housing Authority of the City of Little Rock, Arkansas, and Petitioner, Philander Smith College will be seriously delayed if said alleys are not closed and vacated immediately. An emergency is therefore declared to exist and this ordinance being necessary for the immediate preservation of the public welfare shall take effect immediately upon its passage and approval. Section 5. All ordinances or parts of ordinances in conflict herewith are hereby repealed. PASSED: June 17, 1968 ATTEST: CLERK APPROVED:
