AN ORDINANCE CONDEMNING CERTAIN PARCELS OF REAL
PROPERTY WITHIN THE PROPOSED RIGHT -OF -WAY FOR
THE RECONSTRUCTION AND IMPROVING OF 65TH STREET
INCLUDING WITHOUT LIMITATION STORM DRAINAGE FA-
CILITIES; DIRECTING THE CITY ATTORNEY TO INSTI-
TUTE CONDEMNATION PROCEEDINGS; AND FOR OTHER
PURPOSES.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF LITTLE ROCK, ARKANSAS.
SECTION 1. The City of Little Rock does hereby condemn
for street right -of -way and related drainage facilities the fol-
lowing parcel of real property situated in the City of Little
Rock, Pulaski County, Arkansas, to -wit:
A parcel of land situated in Section 25, Township
1 North, Range 13 West, City of Little Rock,
Pulaski County, Arkansas, more particularly described
as follows:
A part of the NEB, SEk, Section 25, beginning at the
Northeast corner of said NEB, SEk; thence South 00
24'35" East 63.5 feet to a point on the West right -
of -way of Geyer Springs Road; thence southwesterly
along said right -of -way 30 feet from the centerline
of road 237.1 feet; thence North 6 040'38" West 156.0
feet; thence along a curve to the left 42.17 feet,
having tangents of 25.8 feet and a radius of 29.0
feet; thence West 105.18 feet; thence North 83 °43'22"
West 201.21 feet; thence West 304.77 feet to a point
on the East right -of -way of the Missouri Pacific
Railroad; thence North 30 157'52" East along said
right -of -way 106.45 feet to a point on the North line
of Section 25; thence North 89 04221" East along said
North line 631.80 feet to the point of beginning; con-
taining 70,713 square feet, more or less.
The aforesaid parcel of real property is needed to be
utilized as right -of -way in the construction and reconstruction of
65th Street in the City of Little Rock and to provide for necessary
storm drainage related thereto.
SECTION 2. The City of Little Rock does hereby condemn in
connection with he reconstruction of the right -of -way and related
drainage facilities of 65th Street in the City of Little Rock a
temporary easement over and across the following described parcel
of land in the City of Little Rock, Pulaski County, Arkansas, to -wit:

A parcel of land situated in Section 25, Township
1 North, Range 13 West, City of Little Rock, Pulaski
County, Arkansas, more particularly described as
follows:
A part of the NEB, SEI, Section 25, commencing at
the Northeast corner of said NEh, SEh; thence South
0 024'35" East 63.5 feet to a point on the West right -
of -way line of Geyer Springs Road; thence southwesterly
along said right -of -way line 30 feet from the center-
line of road 237.1 feet to the point of beginning;
thence South 0 024'35" East along said West right -of -way
line 150.0 feet; thence South 89 035'25" West 15.0 feet;
thence North 0 024'35" West 250.0 feet; thence North
89 035'25" East 5.0 feet; thence South 6 040'38" East
100.5 feet to the point of beginning; containing 3,250
square feet, more or less.

SECTION 3.

The City Attorney is hereby authorized and
directed to file in the proper court proceedings for the condemna-
tion of the property described in Sections 1 and 2 hereof, and to
secure an order of such court permitting the City to take immediate
possession of said property upon posting a bond in an amount to be
determined by the court and to do any and all other things necessary
in order to obtain immediate possession of said property.
SECTION 4. Sixty -fifth (65th) Street in its present condi-
tion is inadequate to accomodate the flow of vehicular traffic uti-
lizing and attempting to utilize said street, thereby causing
congestion of traffic thereon and on streets adjacent thereto; and
the proposed improvement of said street is designed to relieve the
congestion of traffic thereby enhancing the health, peace and safety
of the citizens of the City of Little Rock. Now, therefore, an
emergency exists and this Ordinance being necessary to protect the
health, peace and safety shall become effective immediately upon
its passage.
