HomeMy WebLinkAbout11983ORDINANCE NO. 119983 AN ORDINANCE RELEASING, VACATING AND ABANDONING A PORTION OF THE ALLEY IN BLOCK ELEVEN (11), CENTENNIAL ADDITION TO THE CITY OF LITTLE ROCK, ARKANSAS, AND FOR OTHER PURPOSES WHEREAS, a petition was duly filed with the Board of Directors of the City of Little Rock on the 5th day of October, 1967, asking the Board of Directors to vacate, abandon and close that part of the alley between the East and West halves of Block Eleven (11), Centennial Addition to the City of Little Rock, Arkansas, said part being more particularly described as follows: Beginning at the North line of said alley abutting Lot One (1) in said block, run thence South to the Southeast corner of Lot Three (3), thence East to Southwest Corner of Lot Ten (1Q, thence North along the East line of said alley to the North- west corner of Lot Twelve (12), thence West to the point of beginning; and, WHEREAS, after due notice as required by law, the Board of Directors has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the part of the alley hereinbefore described has been dedicated to the use of the general public as an alley and that Arkansas Baptist Medical Center, a public non - profit hospital corporation, desires and finds it necessary that the portion of the alley above described, together with the lots abutting upon said portion, be prepared as an enclosed off - street motor vehicle parking lot, as an addition to its presently existing hospital building, which constitutes a present need, and as a site for future expansion of its existing buildings and facilities; and, 0 WHEREAS, it has been found that said Arkansas Baptist Medical Center is a public, non - profit charitable institution dedicated to the healing of the sick and infirm, that it owns the realty abutting upon the portion of the alley above described and that, in order to serve the expanded health needs of the community and to avoid congestion of traffic in the vicinity of said medical center, it requires the use of said portion of said alley, and the lots abutting thereon, to construct upon the same an enclosed motor vehicle parking lot for the use of said medical center, its employees, tenants, licensees and invitees, as an addition to its present hospital buildings, and for possible future expansion of said buildings; and it has been further found that the public interest and welfare will not be adversely affected by the closing and abandonment of the described portion of said alley; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK: SECTION 1. The City of Little Rock, Arkansas, hereby releases, vacates and abandons all its rights, together with the rights of the public generally, in and to that portion of the alley between the East and West halves of Block Eleven (11), Centennial Addition to the City of Little Rock, Arkansas, said portion being more particularly described as follows: Beginning at the North line of said alley abutting Lot One (1) in said block, run thence South to the Southeast corner of Lot Three (3), thence East to Southwest corner of Lot Ten (10), thence North along the East line of said alley to the Northwest corner of Lot Twelve (12), thence West to the point of beginning. SECTION 2. There is hereby reserved unto all public utility companies now operating under franchise from the City of Little Rock,and unto the successors and assigns of each of said utility companies, all of the rights, privileges, authority, easements, land spaces and spaces above the lands they now hold, own or occupy upon, underneath and above that part of the above described alley, notwithstanding the form, manner or procedures under which such rights, privileges, authority and spaces were acquired by said utility companies. There is also hereby reserved unto the City of Little Rock the right of ingress and egress over and upon said lands for the purpose of main- taining and controlling drainage in said area. SECTION 3. A copy of this Ordinance, duly certified by the City Clerk, shall be filed in the office of the Recorder of Pulaski County and shall be recorded in the Deed Records of said County. SECTION 4. All ordinances and parts of ordinances in conflict herewith are repealed. SECTION 5. WHEREAS, expanded hospital facilities are a present need in the City of Little Rock in order to provide improved services to the public, and it has been found, and it hereby is declared, that said needs will be met in part by the provision of a greater number of off - street parking spaces for motor vehicles in the vicinity of said medical center, thus relieving congestion of traffic in the vicinity thereof, an emergency hereby is declared to exist, and, therefore, this ordinance shall take effect and be in force immediately.
