HomeMy WebLinkAbout12257t ORDINANCE NO. 12,257 AN ORDINANCE RELATING TO THE PRESERVATION OF PUBLIC PEACE, HEALTH AND SAFETY; AUTHORIZING THE BOARD OF DIRECTORS THROUGH THE MAYOR TO PROCLAIM A STATE OF EMERGENCY IN CERTAIN INSTANCES AND PROHIBIT BY ORDER ACTS WHICH IMPERIL SUCH PUBLIC PEACE, HEALTH AND SAFETY; MAKING VIOLATIONS OF SUCH ORDERS A MISDEMEANOR; DECLARING EMERGENCY; PROVIDING FOR NOTICE AND FILING OF SUCH PROCLAMATION AND ORDERS; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. In the event of a natural disaster, rioting, catastrophe, or similar public emergencies within the corporate limits of the City of Little Rock or in the event of a reasonable likelihood of immediate danger thereof and upon a finding by the Board of Directors of the City of Little Rock speaking through the Mayor thereof, that the public safety is imperiled thereby, the said Board and Mayor may proclaim a state of emergency within any part or all of the territorial limits of this City. Following such proclamation and through the continuance of such state of emergency, the Board of Directors and the Mayor may promulgate the following orders to protect the life and property or to bring the emergency situation under control. Such orders may, within any part or all of the territorial limits of the City of Little Rock, provide for: a. the establishment of a curfew and the prohibition and control of pedestrians and vehicular traffic, except essential emergency vehicles and personnel; b. the designation of specific zones within which the occupancy and use of buildings and the ingress and egress of vehicles and persons may be prohibited or regulated; c. the regulation and closing of places of amusement and assembly; d. the prohibition of the sale and distribution of alcoholic beverages; e. the prohibition and control of the presence of persons on public streets and places; f. the regulation and control of the possession, storage, display, sale, transport and use of firearms, other dangerous weapons and ammunition; g. the regulation and control of the possession, storage, display, sale, transport and use of explosives, and flammable materials and liquids. ccc -0 0 -S • M -2- SECTION 2. Such orders shall be effective from the time and in the manner prescribed in such orders which shall be filed immediately in the office of the City Clerk, and shall be published as soon as practicable in a newspaper of general circulation in the area affected by such order and transmitted to the radio and television media for publication and broadcast. Such orders may be amended, modified and rescinded in like manner by the Board of Directors and Mayor during the pendency or existence of the state of emergency. Such orders shall cease to be in effect five days after their promulgation or upon declaration by the Board of Directors and Mayor that the state of emergency no longer exists, whichever occurs sooner. The Board of Directors and Mayor, nevertheless, may extend the effect of such orders for successive periods of not more than five days each by republication of such orders in the manner hereinbefore provided. SECTION 3. Any person who violates any order promulgated pursuant to this Ordinance shall be guilty of a misdemeanor. SECTION 4. WHEREAS, due to threatened acts of violence to both persons and property of a widespread nature throughout this City a more effective means is needed to preserve the public peace, health and safety. NOW THEREFORE, an emergency is hereby declared to exist and this Ordinance shall be in full force and effect from and after its passage. PASSED: August 18, 1969 ... -. / Cify Clerk _.
