HomeMy WebLinkAbout12255I ORDINANCE NO. 12,255 AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO ENTER INTO AND EXECUTE A LEASE AGREEMENT ON BEHALF OF THE CITY OF LITTLE ROCK FOR CERTAIN PROPERTY HEREINAFTER DESCRIBED; AND FOR OTHER PURPOSES. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. The Mayor and City Clerk are hereby authorized and directed on behalf of the City of Little Rock to execute and deliver the following Lease Agreement: -2- SECTION 2. This Ordinance shall be in full force and effect from and after its passage. PASSED: August 18, 1969 ATTEST: � gWZ4 City Cler 1 � • LEASE AGREEMENT THIS INDENTURE OF LEASE made and entered into this day of August, 1969, by and between the City of Little Rock, Arkansas, acting through the Mayor and City Clerk of the said City pursuant to the provisions of Ordinance Rio. , hereinafter called the "Lessor" and T. A. Dillaha, Sr., T. A. Dillaha, Jr., and Daphne Dillaha Thompson, Partners doing business as Dillaha Fruit Company, hereinafter called 'the "Lessees ", WITNESSETH: 1. That the Lessor, for the consideration, purposes and covenants hereinafter set out, does hereby let, lease and demise unto the said Lessees the following described premises located in Pulaski County, Arkansas, to -wit: A parcel of land located in Cumberland Street adjacent to the west line of the south half of Block 35, Original City of Little Rock, more particularly described as follows: Beginning at the southwest corner of Block 35, Original City of Little Rock; thence west, along the south line of Block 35, extended 9.4 feet thence 17.2 feet along a curve to the right having a radius of 29.5 feet, the tangent to said curve having a deflection of 48 degrees 40 minutes; thence in a northwesterly direction from said point 87.0 feet along a line tangent to the curve at said point; thence along a curve to the left, said curve having a radius of 139.5 feet, to an intersection with the north line of the south half of Block 35 extended; thence eastward, along the north line of the south half of Block 35, extended, to the northwest corner of lot 7 of Block 35; thence south along the west line of lot 7, of Block 35 to the point of beginning; containing 5,373 square feet, more or less. 2. The term of this lease is one (1) year, commencing on the day of August, 1969, and ending on the day of August, 1970. 3. The Lessees shall have the option to renew this lease at its termination on a year -to -year basis at the same annual rental. 4. Lessees agree to pay, and Lessor agrees to accept, as rental for the said premises, the sum of Two Hundred Dollars :• ($200) annually payable in advance on the date of execution -2- of this lease and on the same day of each year thereafter during the term hereof. The demised premises shall be used by the Lessees only as a means of ingress and egress to their premises and for the handling and parking of vehicles owned by and doing business with the Lessees. 6. Lessees shall not erect, or allow to be erected, any improvements whatsoever on the demised premises, with the exception that the Lessees may pave or hard surface said premises. 7. Lessees shall maintain the demised premises in a clean and sanitary condition at all times. 8. Lessees shall not assign this lease nor sublet the demised premises without the written consent of the Lessor. 9. Lessor shall not be called upon for any expense of any kind in connection with the upkeep and :maintenance of the above described property during the term of this lease. 10. The Lessor shall have the right to terminate this lease at any time the legislative body of the said Lessor shall determine that the demised premises are needed by the Lessor for any public purpose whatsoever. In the event that the Lessor exercises its right to terminate this lease it shall be allowed to do so without any damage or expense whatsoever to itself.
