HomeMy WebLinkAbout12234ORDINANCE NO. 12,234 AN ORDINANCE PROHIBITING RECREATIONAL ACTIVITY AND VARIOUS OTHER ACTS UPON CERTAIN MUNICIPAL WATERWORKS PROPERTIES, SPECIFYING A FINE FOR THE VIOLATION OF THIS ORDINANCE AND DECLARING AN EMERGENCY BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. It shall be unlawful for any person: a. To pollute, fish, boat, swim or wade in or upon any of the following waters of the Little Rock Municipal Water Works: Ozark Point Filter Plant, Pleasant Valley Filter Plant and Jackson Auxiliary Reservoir; b. To climb, break or cut any fence of the Little Rock Municipal Water Works surrounding or abutting any of the aforesaid properties; and c. To walk, camp or hunt or carry on any recreational activity on the grounds of Jackson Auxiliary Reservoir without prior permission from the Board of Commissioners of the Little Rock Municipal Water Works. Section 2. Any person who shall violate any of the provi- sions of this ordinance shall, upon conviction, be fined Twenty Five Dollars ($25.00) for the first offense and, upon conviction for a second or subsequent violation of this ordinance, shall be fined Fifty Dollars ($50.00). Section 3. It has been found that persons have cut and broken fences surrounding some of the aforesaid properties; that persons have been fishing, diving and swimming in some of the aforesaid waters; that said acts can result in contamination f � of the city's water supply and that swimming in Jackson Auxiliary Reservoir is dangerous to the swimmer because of suction from the intake tower. Therefore, an emergency is hereby declared to exist and in order to protect the public health, safety and welfare, this ordinance shall be in full force and effect from and after its passage and approval.
