AN ORDINANCE VACATING, ABANDONING-AND CLOSING
THE NORTH -SOUTH ALLEY LOCATED WITHIN BLOCK 32,
ORIGINAL CITY OF LITTLE ROCK, ARKANSAS.
WHEREAS, a Petition was duly filed by the State of Arkansas,
acting by and through the Arkansas Territorial Restoration Com-
mission, with the Board of Directors of the City of Little Rock,
Arkansas, asking the Board of Directors-to vacate, abandon and
close the North -South alley located within Block 32, Original
City of Little Rock, Arkansas, same being more particularly
described in said Petition and hereafter; and
WHEREAS, after due notice as required by law, the Board of
Directors has, at the time and place mentioned in the Notice,
heard all persons desiring to be heard on the question and has
ascertained that said North -South alley located within Block 32,
Original City of Little Rock, Arkansas, is no longer needed ore
required for corporate purposes or for use by the general public
and adjoining owners in that other streets and alleys are available
and used for these purposes; and
WHEREAS, Petitioner, State of Arkansas, acting by and through
the Arkansas Territorial Restoration Commission, is the only
abutting landowner upon said North -South alley located within
Block 32, Original City of Little Rock, Arkansas, to be vacated
and accordingly all abutting landowners have consented to such
abandonment, and that the public interest and welfare will hot
be adversely affected by the abandonment thereof;
NOW, THEREFORE, BE IT ORDAINED BY-THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
Section 1. The City of Little Rock, Arkansas, under its
powers including those set forth in Arkansas Statutes (1947)

Section 19 -2304, hereby vacates, abandons and closes the North-
South alley located within Block 32, Original City of Little
Rock, Arkansas, said alley which is hereby vacated, abandoned
and closed being more particularly described as follows:
Beginning at the Northeast corner of Lot 1, Block 32,
Original City of Little Rock, Arkansas; run thence
South along the West right of way line of the North -
South alley located within Block 32, Original City of
Little Rock, Arkansas, to the Southeast corner of
Lot 6, Block 32, Original City of Little Rock, Arkansas;
run thence East along the North right of way line of
East Third Street to the Southwest corner of Lot 7,
Block 32, Original City of Little Rock, Arkansas; run
thence North along the East right of way line of the
North -South alley located within Block 32, Original
City of Little Rock, Arkansas, to the Northwest corner
of Lot 12, Block 32, Original City of Little Rock,
Arkansas; run thence West along the South right of way
line of East Second Street to the point of beginning.
(Same being also described as: All of the North -South
alley located within Block 32, Original City of Little
Rock, Arkansas.)
And the City of Little Rock, Arkansas hereby relinquishes unto
the adjoining landowner, State of Arkansas, acting by and through
the Arkansas Territorial Restoration Commission, its successors
and assigns, all of the right, title and interest of the City of
Little Rock, Arkansas, and of its inhabitants, and the public
generally, in respect to said alley which is vacated, abandoned
aid closed as aforesaid.
Section 2. The rights now held by any public utility com-
pany, under the laws of the State of Arkansas or under grants
heretofore made by the City of Little Rock, Arkansas, to use the
North -South alley located within Block 32, Original City of Little
Rock, Arkansas, as described in Section 1 above, for the location
and operation of lines and facilities for the furnishing of public
utility services, shall not be abrogated, diminished or changed by

the enactment of this Ordinance, and utility easements now in
effect are specifically excepted from this closing.
Section 3. A copyof this Ordinance, duly certified by the
City Clerk, shall be filed in the office of the Recorder of
Pulaski County, Arkansas, and recorded in the deed records of
said County.
Section 4. The expansion and further development of the
Arkansas Territorial Restoration grounds and facilities to include
the West Half (Wk) of Block 32, Original City of Little Rock,
Arkansas, will be seriously delayed if said alley is not closed
and vacatedimmediately. An emergency is therefore declared to
exist, and this Ordinance being necessary for the immediate preser-
vation of the public welfare, shall take effect immediately upon
its passage and approval.
Section 5. All ordinances or parts of ordinances in conflict
herewith are hereby repealed.
