ORDINANCE NO. 12,170
ORDINANCE OF THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS, VACATING,
ABANDONING, AND CLOSING A CERTAIN ROAD RIGHT
OF WAY LOCATED WITHIN THE CITY OF LITTLE ROCK,
ARKANSAS.
WHEREAS, on the 30th day of October, 1968, a
petition was duly filed with the Board of Directors of
the City of Little Rock, Arkansas, asking the Board of
Directors to vacate, abandon, and close a road right of
way located within the City of Little Rock, Arkansas,
and described in certain warranty deeds recorded in
Deed Record Book 324 at pages 112 and 113 in the office
of the Circuit Clerk and Recorder of Pulaski County,
Arkansas, and
WHEREAS, after due notice as required by law,
the Board of Directors has, at the time and place mentioned
in the notice, heard all persons desiring to be heard on
the question and has ascertained that said road right of
way has heretofore been dedicated to the public for use as
a roadway as hereinafter described; that said road right of
way is no longer needed or required for oDrporate purposes
or for use by the general public and adjoining owners; that
all of the owners of the property abutting upon said road
right of way have filed with the Board of Directors their
written consent to such abandonment and that the public
interest and welfare will not be adversely affected by the
abandonment of such roadway;
NOW, THEREFORE, be it ordained by the Board of
Directors of the City of Little Rock, Arkansas:

Section 1. The City of Little Rock, Arkansas,
hereby releases, vacates and abandons all of its rights,
together with the rights of the public generally, in and
to the road right of way described as follows:
A portion of a road right of way along
the East line of the Northwest Quarter
(NW'k), Section 27, Township 2 North,
Range 13 West, Pulaski County, Arkansas,
described as follows:
Commencing at the northeast corner of
the Northwest Quarter (NW'k) of Section 27,
Township 2 North, Range 13 West;
Thence South 00 28' 08" East along the
East line of the above described property
for a distance of 409.15 feet to the
Point of Beginning;
Thence continuing South 00 28' 08" East for
a distance of 2241.73 feet to a point, said
point being the southeast corner of the above
described tract;
Thence North 880 17' 38" West for a distance
of 20.01 feet to a point;
Thence North 00 28' 08" West for a distance
of 2543.84 feet to a point on the South
right of way line of Arkansas State Highway
No. 10;
Thence South 670 10' 50" East along the South
right of way line of Arkansas State Highway
No. 10 for a distance of 43.54 feet to a point;
Thence South 00 28' 08" East for a distance
of 285.65 feet to a point;
Thence South 890 31' 52" West for a distance
of 20.00 feet to the Point of Beginning;
subject, however, to any public utility easements located
in said road right of way.
Section 2. A copy of this Ordinance, duly
certified by the City Clerk, shall be filed in the office
of the Circuit Clerk and Recorder of Pulaski County, Arkansas,
and recorded in the deed records of said County.

Section 3. The redevelopment of lands abutting
on said road right of way and the construction of other
public ways will be seriously delayed if said road right
of way is not closed and vacated immediately. An emergency
is therefore declared to exist, and this Ordinance being
necessary for the immediate preservation of the public
welfare shall take effect immediately upon its passage
and approval.
