HomeMy WebLinkAbout12163ORDINANCE NO. 12,163 AN ORDINANCE VACATING, ABANDONING AND CLOSING THE NORTH -SOUTH ALLEY LOCATED WITHIN BLOCK 3, ORIGINAL CITY OF LITTLE ROCK, ARKANSAS, IN CONFORMANCE WITH THE PROVISIONS OF THE URBAN RENEWAL PLAN FOR THE CENTRAL LITTLE ROCK URBAN RENEWAL PROJECT, PROJECT ARK R -12; AND FOR OTHER PURPOSES. WHEREAS, under the provisions of Resolution No. 1003, duly adopted by the Board of Directors of the City of Little Rock, Arkansas, on December 18, 1961, the Urban Renewal Plan of the Housing Authority of the City of Little Rock, Arkansas, for the Central Little Rock Urban Renewal Project, Project No. ARK R -12, was formally approved; and WHEREAS, said Board of Directors in said Resolution found that in order to implement and facilitate the effectuation of said Urban Renewal Plan, certain official action must betake by the Board of Directors, including the vacating, abandoning, and closing of certain streets, alleys, and other public ways, all as provided for in said Urban Renewal Plan; and WHEREAS, the objectives of said Urban Renewal Plan have now been sufficiently attained to require that official action be taken at this time to vacate, abandon and close the North -South alley located within Block 3, ORIGINAL CITY OF LITTLE ROCK, Arkansas, said alley being no longer needed for corporate purposes; and WHEREAS, in order to better provide for the public welfare, safety, comfort and convenience of the general public and the inhbbitants of the City of Little Rock, Arkansas, it is necessary at this time to vacate, abandon and close the North -South alley located within Block 3, ORIGINAL CITY OF LITTLE ROCK, Arkansas, as Page Two more particularly described hereinafter: NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. The City of Little Rock, Arkansas, under its powers as set forth in Arkansas Statutes (1947) Annotated, Sec- tions 19 -2304, 19 -3029, and 19 -3817, hereby vacates, abandons and closes the North -South alley located within Block 3, ORIGINAL CITY of Little Rock, Arkansas; said alley which is hereby vacated, abandoned and closed being more particularly described as follows: Beginning at the Northeast corner of Lot 1, Block 3, Original City of Little Rock, Arkansas; run thence South along the West right -of -way line of the North - South alley located within Block 3, Original City of Little Rock, Arkansas to the Southeast corner of Lot 6, Block 3, Original City of Little Rock, Arkansas; run thence East along the North right -of -way line of East Third Street to the Southwest corner of Lot 7, Block 3, Original City of Little Rock, Arkansas; run thence North along the East right -of -way line of the North -South alley located within Block 3, Original City of Little Rock, Aiiansas to the Northwest corner of Lot 12, Block 3, Original City of Little Rock, Arkansas; run thence West along the South right -of -way line of East Second Street to the point of beginning. (Same being also described as: All of the North -South alley located within Block 3, Original City of Little Rock, Arkansas.) And the City of Little Rock, Arkansas hereby relinquishes unto the adjoining landowner, Housing Authority of the City of Little Rock, Arkansas, its successors and assigns, all of the right, title, and interest of the City of Little Rock, Arkansas, and of its inhabitants, and the public generally, reserving the rights of public utilities, in respect to said alley which is vacated, abandoned and closed as aforesaid. Section 2. The rights now held by any public utility company, under the laws of the State of Arkansas or under grants heretofore made by the City of Little Rock, Arkansas, to use the North -South alley located within Block 3, Original City of Page Three Little Rock, Arkansas, as described in Section 1 above, for the location and operation of lines and facilities for the furnishing of public utility services, shall not be abrogated, diminished or changed by the enactment of this Ordinance, and utility ease- ments now in effect are specifically excepted from this closing, it being expressly unddrstood that the public utility easements herein referred to as reserved to said public utilities shall be no less than the full length and lull width of said alley; 13 feet, 6 inches above and of indeterminate depth below the surface grade of said alley. Section 3. A copy of this Ordinance, duly certified by the City Clerk, shall be filed in the office of the Recorder of Pulaski County, Arkansas, and recorded in the deed records of said County. Section 4. The redevelopment of the lands located within Block 3, Original City of Little Rock,Arkansas, now owned by Housing Authority of the City of Little Rock, Arkansas, as part of its Urban Renewal Plan, will be seriously delayed if said alley is not closed and vacatedimmediately. An emergency is therefore declared to exist, and this Ordinance being necessary for the immediate preservation of the public welfare, shall take effect immediately upon its passage and approval. Section 5. The Board of Directors finds that this Ordinance is enacted at the request Little Rock, Arkansas, as Block 3, ORIGINAL CITY of this Ordinance is enacted owners and proprietors of ORIGINAL CITY of Little R of the Housing Authority of the City of the owner of all lands located within Little Rock, Arkansas; and accordingly with the unanimous approval of the all lands located in said Block 3, ock, Arkansas.
