HomeMy WebLinkAbout12127.r ORDINANCE NO. 12,127 ORDINANCE OF THE BOARD OF DIRECTORS OF THE CITY OF LITTLE RACK, ARKANSAS, VACATING AND CLOSING THE ALLEY IN_BIACK 1, RATTEREES FOREST PARK HIGHLAND ADDITION TO THE CITY OF LITTLE ROCK, ARKANSAS. WHEREAS, a petition was duly filed with the Board of Directors of the City of Little Rock, Arkansas, on the 1st day of July, 1968, asking the Board of Directors to vacate and abandon all of the alley in Block 1, Ratteree's Forest Park Highlands Addition to the City of Little Rock, as designated on the plat of said Addition now appearing of record in Deed Book 1, Page 152, in the office of the Recorder of Pulaski County, Arkansas, subject, however, to any public easements in said alley; and WHEREAS, after due notices as required by law, the Board of Directors has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the alley, hereinbefore described, has heretofore been dedicated to the public use as a alley, as herein described; has not been actually used by the public generally for a period of at least five (5) years subsequent to the filing of the plat; that all of the owners of the property abutting upon the alley to be vacated have filed with the Board of Directors their written consent to such abandonment; and that public interest and welfare will not be adversely affected by the abandonment of such alley; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The City of Little Rock, Arkansas, hereby releases, vacates and abandons all its rights, together with the right of the public generally, in and to the alley designated as follows: That portion of an, alley extending from the west line (extended northerly) of Lot 10, Block 1, Ratteree's Forest Park Highlands Addition to the City of Little Rock, Pulaski County, Arkansas, Easterly 150 feet, more or less, to the East line (extended Northerly) of Lot 12, Block 1, Ratteree's Forest Park Highland's Addition to the City of Little Rock, except any portion thereof recently dedicated or now being dedicated as Bryant Street; provided, that the existing water line easement along the existing water line and other existing utility or sewer easements, Oct- 4 e{ f= - T Page 2 if any, over and through said portion of the alley vacated herein including the right to repair, replace and enlarge the same as future demands may require, shall not be changed or disturbed by this ordinance, subject, however, to any public utility easements located in said alley. SECTION 2. A copy of this Ordinance, duly certified by the City Clerk, shall be filed in the office of the Recorder of Pulaski County and recorded in the Deed Records of the County. SECTION 3.
