HomeMy WebLinkAbout12124ORDINANCE NO. 12,124 AN ORDINANCE VACATING, ABANDONING AND CLOSING GARFIELD STREET BETWEEN EVERGREEN STREET (FORMERLY "K" STREET) AND "J" STREET IN THE CITY OF LITTLE ROCK, ARKANSAS. WHEREAS, a Petition was duly filed by First Baptist Church with the Board of Directors of the City of Little Rock, Arkansas, asking the Board of Directors to vacate, abandon and close Garfield Street between Evergreen Street (formerly "K" Street) and "J" Street in the City of Little Rock, Arkansas, same being more particularly described in said Petition and hereafter; and WHEREAS, after due notice as required by law, the Board of Directors has, at the time and place mentioned in the Notice, heard all persons desiring to be heard on the question and has as- certained that Garfield Street between Evergreen Street (formerly "K" Street) and "J" Street in the City of Little Rock, Arkansas, is no longer needed or required for corporate purposes or for use by the general public and adjoining owners in that other streets are available and used for these purposes, and that Petitioner, First Baptist Church, is the only abutting landowner upon the street to be vacated in these proceedings, and accordingly all abutting land- owners have consented to such abandonment, and that the public interest and welfare will not be adversely affected by the abandon- ment thereof; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. The City of Little Rock, Arkansas, hereby re- leases, vacates and abandons all its rights, together with the rights of the public generally, in and to Garfield Street between Evergreen Street (formerly "K" Street) and "J" Street in the City -13 of Little Rock, Arkansas, more particularly described as follows: Garfield Street between Evergreen Street (formerly "K" Street) and "J" Street in the City of Little Rock, Pulaski County, Arkansas, more particularly described as follows: Beginning at the point of intersection of the west right- of-way line of Garfield Street and the south right -of -way line of Evergreen Street (formerly "K" Street); thence south along the west right -of -way line of Garfield Street to the point of intersect- ion of the north right -of -way line of "J" Street and the west right -of -way line of Evergreen Street (formerly "K" Street); thence east to the east right - of -way line of Garfield Street; thence north along the east right -of -way line of Garfield Street to its point of intersection with the south right -of -way line of Evergreen Street (formerly "K" Street); thence west along the south right -of -way line of Evergreen Street (formerly "K" Street) to the point of begin- ning. and ownership thereof except as to utility easements provided for in Section 2 hereafter shall be vested in the Petitioner herein in the manner according to law to which it is entitled. Section 2. That the rights now held by any public utility company, under the laws of the State of Arkansas or under grants here- tofore made by the City of Little Rock, Arkansas, to use the street as described above in Section 1, for the location and operation of lines and facilities for the furnishing of public utility services shall not be abrogated, diminished or changed by the enactment of this Ordinance, and utility easements now in effect are specifically excepted from this closing. Section 3. A copy of this Ordinance, duly certified by the City Clerk, shall be filed in the office of the Recorder of Pulaski County, Arkansas, and recorded in the deed records of said County. - 2 - Section 4. All ordinances or parts of ordinances in conflict herewith are hereby repealed.
