ORDINANCE OF THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK,
ARKANSAS, VACATING AND CLOSING PART OF A STREET IN UNIVERSITY
HEIGHTS (ASHTON PARK) ADDITION TO THE CITY OF LITTLE ROCK,
ARKANSAS.
WHEREAS, a petition was duly filed with the Board of Directors of the City
of Little Rock, Arkansas, on the 12th day of October, 1970, asking the Board of
Directors to vacate and abandon part of a street in University Heights (Ashton
Park) Addition to the City of Little Rock, as designated on the plat of said
Addition now appearing in Plat Book 1, Page 93, and Plat Book 1, Page 107, in
the Office of the Recorder of Pulaski County, Arkansas.
WHEREAS, after due notice as required by law, the Board of Directors has, at
the time and place mentioned in the notice, heard all persons desiring to be heard
on the question and has ascertained that the street hereinafter described has
heretofore been dedicated to the public use as a street as herein described; has
not been actually used by the public generally for a period of at least five (5)
years subsequent to the filing of the plat; that all of the owners of the property
abutting on the portion of the street to be vacated have filed with the Board of
Directors their written consent to such abandonment; and that public interest and
welfare will not be adversely affected by the abandonment of such street; and it
is in the best interest of the City of Little Rock to vacate said street.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
LITTLE ROCK, ARKANSAS:
SECTION 1. The City of Little Rock, Arkansas hereby releases, vacates and
abandons all its rights, together with the rights of the public generally, in and
to the street designated as follows:
That part of Esper Street extended eastward from the Northwest corner
of Lot 12, Block 48, to the East boundary line of the SE14 of the Si4
of Section 27, Township 2 North, Range 13 West.
SECTION 2. A copy of this Ordinance, duly certified by the City Clerk shall
be filed in the Office of the Recorder of Pulaski County, Arkansas, and recorded
in the Deed Records of the County.
SECTION 3. This Ordinance shall take effect and be in force from and after
its passage.
