ORDINANCE NO. 12,311
AN ORDINANCE AMENDING SECTIONS 4 -15 AND 4 -24 OF THE CODE OF
ORDINANCES OF THE CITY OF LITTLE ROCK, ARKANSAS, SAME SECTIONS
DEALING WITH HOURS OF SALE, VIOLATIONS AND PENALTIES FOR THE
SALE OF ALCOHOLIC LIQUORS AND LIGHT WINES AND BEER; DECLARING
AN EMERGENCY; AND FOR OTHER PURPOSES.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
LITTLE ROCK, ARKANSAS.
SECTION 1. Section 4 -15 of the Code of Ordinances of the City of Little
v Rock, Arkansas, is hereby amended to read as follows:

Section 4 -15. Hours of sale; violations; penalty.
It shall be unlawful for any person, firm or corporation to sell,
offer for sale or give away at wholesale any spirituous, vinous,
malt or other intoxicating alcoholic liquor before the hour of
eight o'clock a.m. and after the hour of six o'clock p.m.

shall be unlawful for any person, firm or corporation to sell,
offer for sale or give away at retail any spirituous, vinous, malt

or other intoxicating alcoholic liquor after the hour of one o'clock

a. m. or before the hour of seven o'clock a.m.; except on Saturday

when all sales must cease by twelve o'clock midnight.

Any person who shall sell intoxicating liquor on Sunday or during
polling hours when two or more candidates are seeking the same
office at any lawfully authorized election, or between one o'clock
a.m. and seven o'clock a.m. on weekdays shall be guilty of a
misdemeanor and for the first offense be punishable by a fine of
not less than one hundred dollars nor more than two hundred fifty
dollars and for the second or subsequent offenses he shall be
guilty of a misdemeanor and punishable by a fine of not less than
two hundred fifty dollars and not more than five hundred dollars
or by imprisonment in the county jail for not less than ten days
or more than six months or both so fined and imprisoned in the
discretion of the court of jury.
Section 4 -24 of the Code of Ordinances of the City of Little Rock,
Arkansas, is hereby amended to read as follows:
Section 4 -24. Hours of sale; penalty for violation.
It is hereby made a misdemeanor for any person, firm or
corporation to sell beer and /or wine or to offer for sale
such after the hour of one o'clock a.m. or before the hour
of seven o'clock a.m.; except on Saturdays when said sales
must cease by twelve o'clock midnight. Any person who shall
sell beer and /or wine on Sunday or during polling hours when two
or more candidates are seeking the same office in any lawfully
authorized election, or between one o'clock a.m. and seven
o'clock a.m. on weekdays or who assists or aids or abets in
the violation of this section shall be guilty of a misdemeanor,
and, upon conviction, shall be fined in any sum not less than
twenty -five dollars and not more than two hundred fifty dollars
for the first offense; and upon conviction of a second or any
successive violation of this section occurring within twelve
months of a preceding conviction, shall be fined as set out above
or shall be imprisoned for not less than one day or more than
thirty days or both, and in addition thereto shall suffer the
revocation of his city license to do business as a retail beer
dealer, if he possesses such license.

SECTION 2. There exists a need to clarify certain City Ordinances
and to achieve some conformity with State Statutes, therefore this Board declares
an emergency to exist and this Ordinance shall be in full force and take effect
from and after its passage and approval.
