HomeMy WebLinkAbout12305ORDINANCE N0. 12,305 ORDINANCE OF THE BDARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS, VACATING AND CLOSING PART OF MARLYN DRIVE AT LOT 273 OF THE AMENDED PLAT OF SECTION "D" OF TWIN LAI= SUBDIVISION TO THE CITY OF LITTLE ROCK, ARKANSAS. WHEREAS, a petition was duly filed with the Board of Directors of the City of Little Rock, Arkansas, on the 7th day of October 19 69 , asking the Board of Directors to vacate and abandon pAtt of Marlyn Drive at Lot 273 of the Amended Plat of Section "D" of Tiwrin Lakes Subdivision to the City of Little Rock, as designated on the plat of said Subdivision now appearing of record in Deed Book 639, Page 949, in the office of the Recorder of Pulaski County, Arkansas, subject, However, to any public easements in said street; AND WHEREAS, after due notices as required by law, the Board of Directors has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the street, hereinbefore described, has heretofore been dedicated to the public use as a street, as herein described; has not been actually used by the public generally for a period of at least five i5i years subsequent to the flllnf of the plat; that all of the owners of the property abutting upon the street to be vacated have filed with the Board of Directors their written consent to such abandonment; and that public interest and welfare will not be adversely affected by the abandonment of such street; NOW, THEREFORE,BE IT ORDAINED BY THE BDARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The City of Little Rock, Arkansas, hereby releases, vacates and abandons all its rights, together with the rights of the public generally, in and to the street designated as follows: Commence at the SW corner of Lot 273 of the Amended Plat of Section "D" of Twin Lakes Subdivision, thence North 67 0221 East along the Southerly line of said Lot 273 a distance of 101.0 feet to the point of beginning, thence continue North 67 °221 East 25 feet, thence Northwesterly 25 feet to a point on the East line of said Lot 273, which point is 75.2 feet from the NE corner of said Lot 273, thence South and Southwesterly 39.27 feet along a curve having a radius of 25 feet to the point of beginning, containing 134.12 square feet. subject, however, to any public utility easements located in said street. SECTION 2, A copy of this ordinance, duly certified by the City Clerk, shall be filed in the office of the Recorder of Pulaski County and recorded in the Deed Records of the County. SECTION 3.
