HomeMy WebLinkAbout12471.r, ' Y ORDINANCE NO. 12,471 AN ORDINANCE VACATING, CLOSING AND ABANDONING SPRING STREET BETWEEN GARLAND AND MARKHAM STREET AND THE EAST -WEST ALLEYS WITHIN BLOCKS 99 AND 100, ORIGINAL CITY OF LITTLE ROCK; DE- CLARING AN EMERGENCY; AND FOR OTHER PURPOSES WHEREAS, the City of Little Rock has immediate plans for devel- oping and constructing a publicly owned vehicular offstreet parking facility, all underground in Blocks 99 and 100, original City of Little Rock and under the surface of the East -West alleys as platted in said blocks and Spring Street between the North right -of -way line of Markham Street extended and the South right -of -way line of Garland Street ex- tended; and WHEREAS, it is found and determined that the said portion of Spring Street and the East -West alleys in said blocks 99 and 100 neces- sarily must be vacated, closed and abandoned in order to make possible the construction of the underground parking facility; and WHEREAS, the closing and abandoning of said street and alleys will not adversely affect the public in that other streets and alleys are available to serve the same purposes; and WHEREAS, the City intends to utilize the air rights over and the surface and subsurface areas of said Street and alleys, fee title to which is found and determined to have always been vested in the City of Little Rock since the recording of the plat pertaining thereto, together with other lands, for a planned convention center complex, all of which, together with the parking facility, is found and deter- mined to be a public purpose. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF - DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. The City of Little Rock, under,its authority and powers including those set forth in Section 19 -2304, Arkansas Statutes, 1947 annotated, hereby vacates and abandons the East -West alleys located within Blocks 99 and 100, original City of Little.Rock and Spring Street, between the North right -of -way line of Markham Street extended and the South right -of -way line of Garland Street extended all as provided on the S - /3 V-1 r t -2- plat for the original City of Little Rock as recorded in Pulaski County, Arkansas records in Book "L" at pages 330 and 331. SECTION 2. The City of Little Rock has determined the need for and immediately plans to construct an offstreet underground vehicular parking facility on lands, among others, including the street and alleys herein vacated and in reaching a judgment in the premises has determined that the said street and alleys are not now needed for such public pur- poses; that the vacation and abandonment of said street and alleys will not adversely affect the general public in that other streets and alleys are available for these purposes; that the air rights over and the sur- face and subsurface property rights in said street and alleys, the fee simple title to which is vested in the City, is to be utilized in what- ever means and manner as the City may deem appropriate so as to accomplish and make possible a planned convention center complex; that said con- vention center complex including, among other facilities, the public offstreet parking and a public plaza'is found and determined to be vi- tally-important to this City from the standpoint of public peace, health, safety and welfare and is therefore, a public purpose which the City is authorized under the law to undertake. SECTION 3. A copy of this Ordinance, duly certified by the City Clerk, shall be filed in the office of the recorder of Pulaski County, Arkansas, and recorded in the deed records of said county. SECTION 4. The construction of the underground vehicular par- king facility by the City, herein identified, will be seriously delayed if the said street and alleys identified in Section 1 hereof are not closed and vacated immediately. Therefore, an emergency is hereby de- clared to exist and this Ordinance being necessary for the immediate pre- servation of the public peace, health, safety and welfare shall take effect immediately upon its passage.
