HomeMy WebLinkAbout12465ORDINANCE NO. 12,465 AN ORDINANCE AMENDING VARIOUS SECTIONS OF THE CODE OF ORDINANCES OF THE CITY OF LITTLE ROCK, ARKANSAS, PROVIDING FOR "MF 611, "MF 12 ", "MF 18 ", AND "MF 24" MULTI- FAMILY ZONING DISTRICTS; AND FOR OTHER PURPOSES (64) Exterior Yard - Any yard within a M -F zoning dis- trict along the property line and fronting on a street. (65) Interior Yard - Any yard within M -F zoning district along the property line and not fronting on a street. SECTION 3. Section 43 -2 of the Code of Ordinances of the City of Little Rock, Arkansas, is hereby amended to read as follows: Districts - In order to regulate and restrict the loca- tion of buildings and other structures and of premises to be used for trade, industry, residence or other specified uses, to regulate and limit the height and bulk of buildings and other structures hereafter erected or altered, to regulate and determine setback building lines and the area of yards and other open spaces, the D -% BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 0 OF LITTLE ROCK, ARKANSAS: � SECTION 1. A� b b 0 SECTION 2. Section 43 -1 of the Code of Ordinances of a) P � 9 0 aa) the City of Little Rock, Arkansas, is further amended by adding o W 04 . W n cy the following two paragraphs to said Section: (64) Exterior Yard - Any yard within a M -F zoning dis- trict along the property line and fronting on a street. (65) Interior Yard - Any yard within M -F zoning district along the property line and not fronting on a street. SECTION 3. Section 43 -2 of the Code of Ordinances of the City of Little Rock, Arkansas, is hereby amended to read as follows: Districts - In order to regulate and restrict the loca- tion of buildings and other structures and of premises to be used for trade, industry, residence or other specified uses, to regulate and limit the height and bulk of buildings and other structures hereafter erected or altered, to regulate and determine setback building lines and the area of yards and other open spaces, the D -% -2- City of Little Rock, Arkansas is hereby divided into districts of which there shall be eighteen, known as: "A "- One - family District "B "- Residence District "C" -Two- family District "MF 611- Multi- family District "MF 1211- Multi- family District "MF 18 "- Multi- family District "MF 2411- Multi- family District "D "- Apartment District "E "- Apartment District "E -1" -Quiet Business and Institu- tional District "E -1 -A "- Nursing Home, Lodging, and Undertaking District "F"- Commercial District "G "- Commercial District "G -1 "- Commercial District "H "- Business District "I" -Light Industrial District "J" -Light Industrial District "K" -Heavy Industrial District The City of Little Rock, Arkansas, is hereby divided into eighteen districts aforesaid and the boundaries of such districts are shown on the official zoning map on file in the office of the City Clerk and made a part of this chapter, being designated as the "District Map ", and said map and all the notations, references and other information shown thereon shall be as much a part of this chapter as if the matters and information set forth by said map were fully described herein. Except as hereinafter provided: (1) No building shall be erected, converted, recon- structed, or structurally altered nor shall any building or land be used for any purpose other than is permitted in the district -3- in which such building or land is located. (2) No building shall be erected, converted, recon- structed, or structurally altered to exceed the height or bulk limit herein established for the district.in which such building is located. (3) No building shall be erected, converted, recon- structed, or structurally altered so as to intrude upon the area required for the front, side, rear, interior, or exterior yards as herein established; provided further that no yard or open space on adjoining property shall be considered as providing a yard or open space for a lot wherever a building is to be erected. (4) No lot area shall be so reduced or diminished that the yards of other open spaces shall be smaller than prescribed by this chapter, nor shall the density of population be increased in any manner except in conformity with the area regulations as hereinafter provided. (5) Every building hereafter erected shall be located on a lot as herein defined and in no case shall there be more than one building on one lot except as hereinafter provided. SECTION 4. Section 43 -4 of the Code of Ordinances of the City of Little Rock, Arkansas is hereby amended to add Sub- section 43 -4.5 and said Subsection shall read as follows: Section 43- 4.5- "MF "- Multi- family Districts (1) Use Regulations In the "MF 6 ", "MF 12 ", "MF 18 ", and "MF 24 "- Multi- family residential districts no building or land shall be used and no building shall be hereafter erected, converted, or struc- turally altered, unless otherwise provided in this chapter, except for one of the following uses: (a) Multi- family Residential (b) Accessory Buildings meeting yard requirements as herein established (c) Accessory recreational uses such as tennis courts, swimming pools, -4- putting greens, and other uses such as washaterias, customarily incident to the above use, when located on the same lot and total- ly within the building setback lines. (d) Name plate not exceeding one square foot in area, signs not ex- ceeding eight square feet in area pertaining to the lease, hire, or sale of the building or premises. (e) All other uses allowable in "A ", "B ", "C", or "D" Districts may be permitted in these districts on approval of the Board of Adjustment of the City of Little Rock, Arkansas. Uses permitted by the Board of Adjustment shall be governed by the appropriate Ordinances; except, as pertaining to yard space. "MF" District yard requirements shall apply. (2) Height and Area Regulations In the "MF "- Multi - family Districts the height of buildings, the minimum dimensions of yards, the minimum detached building separation and the minumum lot area per family shall be as follows: (a) Height. In the "MF "- Multi- family Districts, no building hereafter erected or structurally altered shall exceed two stories or thirty -five feet. (b) Exterior Yards. All exterior yards shall have a depth of not less than twenty -five feet. (c) Interior Yards. All interior yards shall have a minimum depth equal to the height of the adja- cent building. (d) Detached building separation. All detached buildings shall be separated by a distance of not 0 less than ten feet. -5- (e) Lot Area Per family. In the "MF" Multi - family Districts, every building for multi - family use hereafter erected or structurally altered shall provide a minimum lot area per family as follows: "MF 6" Districts 7000 Square feet "MF 12" Districts 3600 Square feet "MF 18" Districts 2400 Square feet "MF 24" Districts 1800 Square feet (3) Height and Area Exceptions (a) In computing the depth of an interior yard for any building where such yard opens onto an alley, one -half of such alley may be assumed to be a portion of that interior yard. (b) Every part of a required yard shall be open from its lowest point to the sky unobstructed except for the ordinary projection of sills, belt courses, cornices, but- tresses, ornamental features and eaves; provided however that none of the above projections shall project into a minimum yard more than two feet. (4) Off - Street Parking The following off - street parking spaces shall be provided on the same lot with the building or within 300 feet thereof, and satisfactorily maintained by the owner of the proper- ty, for each building which is hereafter erected, enlarged or altered for multi - family residential purposes: Efficiency Unit 135 spaces per unit 1 Bedroom Unit 1:� spaces per unit 2 Bedroom Unit or larger 2 spaces per unit In the case of more than one required exterior yard, all but one yard may be used in its entirety for required off- street parking, provided that the remaining yard be planted and maintained as a landscaped area. Any interior yard may be used l . Q. in its entirety for required off - street parking. In the event that any parking area adjoins a lot in a residential district or is across the street from a residential district, a compact evergreen screen or a permanent type opaque fence of wood, masonry, or metal construction having a height of not less than four feet shall be erected and maintained between such area and the residential zone. Any light used to illuminate said parking area shall be so arranged as to reflect the light away from adjacent properties or from properties located across the street. SECTION 5. Section 43 -21 (A) Class 1. Residential Units (b) is hereby amended to read as follows: (OFor any building or structure containing three or more dwelling units, there shall be provided one parking space for each unit thereof; except that in a "MF" District the requirements of that district as set out in Section 43 -4.5 shall apply.
