AN ORDINANCE CONDEMNING A PERMANENT AND
PERPETUAL EASEMENT AND ALSO A TEMPORARY
EASEMENT OVER AND ACROSS CERTAIN LANDS
LOCATED IN THE CITY OF LITTLE ROCK FOR
THE PURPOSE OF CONSTRUCTING A DRAINAGE
DITCH AND FOR GENERAL DRAINAGE PURPOSES
IN CONNECTION WITH THE MODEL CITIES
AGENCY PROGRAM; DIRECTING THE CITY ATTORNEY
TO INSTITUTE PROPER EMINENT DOMAIN PRO-
CEEDINGS TO CARRY OUT THE INTENT AND PUR-
POSES THEREOF; AND FOR OTHER PURPOSES
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS.
SECTION 1. The City of Little Rock does hereby condemn an
easement for the purpose of constructing a drainage ditch over
and across the following described parcel of real property
situated in the City of Little Rock, Arkansas:
PARCEL 5. The East 10' of Lot 5, and the South
3' of Lot 6, Block 5, Harrington's
Second Industrial Addition to the
City of Little Rock, Arkansas.
The aforesaid easement is necessary to provide proper
drainage in the area of the East side of the City of Little
Rock and to prevent overflow of adjacent lands.
The easement hereby condemned shall be permanent and
perpetual for the public use as hereinabove stated.
SECTION 2. The City of Little Rock, Arkansas does also
condemn an easement for the purpose of constructing a drainage
ditch over and across the following described parcels of real
property situated in the City of Little Rock, as follows:
PARCEL 5. The East 25' of Lot 5 and the South 3'
of Lot 6, Block 5, Harrington's Second
Industrial Addition to the City of
Little Rock, Arkansas.
PARCEL 49. The East 25' of Lot 6, Block 49,
Industrial Park Addition.
PARCEL 71. The East 25' of Lot 10, Block 50,
Industrial Park Addition.
The aforesaid easements mentioned in Section 2 hereof are
necessary to provide for the construction and reconstruction of

to
a ditch adjacent to the described properties and the easements
mentioned in Section 2 hereof shall terminate upon the completion
of the construction of the said drainage ditch and the acceptance
of such construction project by the City of Little Rock.
SECTION 3. The City Attorney is hereby authorized and
directed to file in the proper court proceedings for the con-
demnation of the easements, the description of which are set out
in Sections 1 and 2 hereof, and to secure an Order of such Court
allowing the City to take immediate possession of such easements
as described upon its posting bond in an amount to be determined
by the Court and to do any and all other things reasonably
necessary in obtaining immediate right of entry to the property
on which said easement is contained.
SECTION 4. Whereas it is found and determined that the
construction of a drainage ditch in the Eastern part of the City
of Little Rock will be delayed and the construction thereof
cannot be performed in the absence of use of the lands des-
cribed in Section 2 hereof and the acquisition of the easement
described in Section 1 hereof and the acquisition of said
easements will expedite construction of the drainage ditch
thereby enhancing public peace, health and safety of the
citizens of this community. Therefore, an emergency is found
to exist and this ordinance being necessary in the implementation
and construction of adequate facilities of a drainage ditch or
a large area of the City of Little Rock, shall be in full force
and effect from and after its passage.
