HomeMy WebLinkAbout125801G ORDINANCE NO. 12,580 AN ORDINANCE VACATING, CLOSING AND ABANDONING EAST 16TH STREET BETWEEN FLETCHER STREET AND CHERRY STREET AND VACATING, CLOSING AND ABANDONING CHERRY STREET BETWEEN EAST 16TH STREET AND EAST 17TH STREET WHEREAS, that portion of East 16th Street lying between the East right -of -way line of Fletcher Street and the East right-of-way line of Cherry Street, and that portion of Cherry Street lying between the North right -of -way line of said East 16th Street and the North right-of-way line of East 17th Street are not required for corporate purposes, are not needed for streets or other public purposes, and the welfare of the City will be enhanced and promoted by the vacating thereof; WHEREAS, after due notices as required by law, the Board of Directors has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the welfare of the City will be enhanced and pro- moted by the vacating, closing and abandoning of said streets; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. The City of Little Rock, under its authority and powers, including those set forth in Section 19 -2304, Ark. Stats., hereby vacates, closes and abandons that portion of East 16th Street lying between the East right -of -way line of Fletcher Street and the East right -of -way line of Cherry Street, and that portion of Cherry Street lying between the North right -of -way line of said East 16th Street and the North right -of -way line of East 17th Street, as shown on the plat of Manufacturer's Addition to the City of Little Rock, Pulaski County, Arkansas, subject, however, to any public utility easements located in said streets and to a drainage easement in favor of the City of Little Rock. r Section 2. The City of Little Rock has determined that said streets are not required for corporate purposes and are not needed for streets or other public purposes; that the welfare of the City will be enhanced and promoted by the vacating thereof; that the vacating and abandoning of said streets will not adversely affect the general public in that other streets are reasonably available; and that other access is available to all property owners affected, directly or indirectly. Section 3. A copy of this Ordinance, duly certified by the City Clerk, shall be filed in the Office of the Recorder of Pulaski County, Arkansas and recorded in the Deed Records of said County.
