HomeMy WebLinkAbout12559A ORDINANCE NO. 12,559 AN ORDINANCE VACATING, CLOSING AND ABANDONING REICHARDT STREET BETWEEN EAST 5th and EAST 6th ADJACENT TO BLOCKS 20 and 21 OF GARLAND'S ADDITION, POLLOCK'S SUBDIVISION TO THE CITY OF LITTLE ROCK, PULASKI COUNTY, ARKANSAS; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES WHEREAS, the City of Little Rock through its Model Cities Program in cooperation with the Little Rock School District has immediate plans for the development of a Parks and Recreation Facility on property previously acquired by the City of Little Rock; and WHEREAS, the City of Little Rock and the Little Rock School District own and have previously acquired the property adjacent to Reichardt Street between East 5th and East 6th Streets; and WHEREAS, the closing and abandoning of said street will not adversely affect the public in that other streets are available to serve the same purposes; and WHEREAS, after due notices as required by law, the Board of Directors has, at the time and place mentioned'in the notice, heard all persons desiring to be heard on the question and has ascertained that the closing of Reichardt Street and the planned recreation facility is found and determined to be a public purpose. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. The City of Little Rock, under its authority and powers including those set forth in Section 19 -2304, Arkansas Statutes, 1947 annotated, hereby vacates and abandons Reichardt Street between East 5th and East 6th Streets adjacent to and lying between Blocks 20 and 21 of Garland Addition, Pollock's Subdivision to the City of Little Rock,Pulaski County, Arkansas. 4. -2- SECTION 2. The City of Little Rock has determined the need for immediate plans to develop a recreation facility on public lands including this street herein vacated and in reaching judg- ment has determined that the said street is not now needed for other public purposes; that the vacating and abandoning of said street will not adversely affect the general public in that other streets and alleys are available for these purposes. SECTION 3. A copy of this Ordinance, duly certified by the City Clerk, shall be filed in the office of the recorder of Pulaski County, Arkansas and recorded in the deed records of said county. SECTION 4. The development of the Parks and Recreation facility herein identified, will be seriously delayed if said street identified in Section 1 hereof is not closed and vacated immediately. Therefore, an emergency is hereby declared to exist and this Ordinance being necessary for the immediate preservation of the public peace, health, safety and welfare shall take effect immediately upon its passage.
